Overview: Real Estate Venture Capital firm in the Bay Area submitted misleading Noise and Vibration impacts to the city to get 8 story hotel project approved 12 feet away from my bedroom window. The noise and vibration impact report shows vibration impacts from 12 feet away from construction equipment, while they select an arbitrary location for noise impacts of 50 feet away. The noise impacts from construction at 12 feet away, are scientifically proven to be harmful.
Basically they knowingly omitted information to get the project approved. They also illegally lobbied with the city to get this approved, but thatβs a different topic.
Do I have a case for damages due to the private nuisance created?
I just had a lovely altercation with a neighbor about my dog sniffing in their yard. Apparently he does not want any dogs to ever touch his unfenced front yard.
Looking up the City code, I found 633.09, which states "Any dog, cat or other animal which scratches, digs or defecates upon any lawn, tree, shrub, plant, building or any other public or private property, other than the property of the owner or person in charge or control of the animal, is hereby declared to be a nuisance"
So just a PSA to anyone who has a neighbor like mine: your dog can sniff in their yard, but not poop.

We bought a new house in California in June. Neighbors just installed three massive flood lights that are aimed above the fence line, unshielded, and not angled down in any way. Theyβre on a .55 acre property (zone R1) and the light hits the back of our property/house (.3 acres, R1), and both our neighbors.
The light is so bright it cannot be fully excluded with our plantation shutters. The lights are directly visible from every window on the back of our home (including master bedroom), hit our neighborβs master baths and/or bedrooms too, and fully light our yards.
Weβre attempting to work with them to get them to shield, re angle, and dim the lights. In the meantime, theyβre running these dusk until 10 PM full blast. We donβt have an HOA, city lighting ordinance excludes single family residences. City has adopted Uniform Building Code and CA Residential code.
If this canβt be dealt with through city code compliance, are there any basic laws that prevent an adjacent property owner from this degree of light trespass?
ETA: Weβve gotten them to use a dimmer and it helps a lot. City is still evaluating it as possible public nuisance because the light crosses our property to the public street we live on. Hoping to get them to shield the lights as well, even if we pay for it (theyβd like to split the cost of replacing the wood fence with block fencing, so we have an $8k bargaining chip by refusing to split costs unless they alter the lights).

I live in CA and am have really inconsiderate neighbors. The noise they make has become unbearable. It is a family with 2 boys and they have a basketball hoop maybe 10-15 or so feet from my room. The boys are out there almost daily and it pretty much sounds like they're bouncing the ball directly in my room whenever they play. I really can't express how loud it is between the bouncing, hitting the backboard, and the noise they make themselves yelling while playing (especially if they have friends over). I'm all for them playing and think it's great they're outside, but I have expressed to their mom how loud it is for us and asked if there's anywhere else they can move the hoop to. She never responded to that request.
Sometimes they're out there past 10pm. Sometimes there's multiple people out there being loud and playing (have counted up to 10...having a full on game of basketball...you can imagine the noise.). The hoop is legit right outside my window. We live down the street from a park. You'd think 10 teenagers playing a basketball game would go there, but nope!
I work from home and honestly just can't take the constant noise anymore. I'm at the point where it gives me so much anxiety and is so triggering that I think dealing with this noise for a few years now has given me Misophonia. I spoke with the mom and she said they won't be out late anymore. I text her one time when it was getting late (about 9pm) and she basically disregarded my concern. We hear them playing from pretty much every room in the house. There is no escaping it. I'm also not in a position to move.
My question is: does this fall under private nuisance? I no longer have peace in my own home and it is really affecting me (and my sanity). If it does fall under a private nuisance, what do you suggest I do? I would prefer not sue them because that's a bit extreme, but I'm not sure what my options are. Should I file a noise complaint with the police? I have multiple videos of how loud it sounds in my room, photos of how close the hoop is to my room, and screen shots of texts with the mom. I also had to buy the noise cancelling earmuffs people wear at a shooting range/ground of an airport to try and block out some noise.
I'm not asking them to stop playing. I'm just asking them to stop playing so close to my room because the constant noise is legit driving me crazy. I don't think that's unreasonable.

A year ago there was a thread about this, and there was no known resolution, but hopefully by now there is a workaround. The workaround a year ago was to edit contacts to put unknown direct to voicemail, but that doesn't seem to work anymore.

I was wondering if someone could help me out with: a) what case/authority provides this definition to us in australia? (specifically victoria if that changes anything)
b) if there are any reported cases involving the scope of the definition in application on "tree roots encroaching a neighbour's property"
I understand that b) may be a bit of an ask; I have absolutely no idea what else to do now, so even if an answer isn't possible, i'd appreciate some help on where to go to research b) myself.

It is unequivocally established that second hand smoke causes harm. If someone wants to harm themselves, that's up to them. But knowingly harming other people is not right and needs to be lawfully actionable.If someone is smoking in public or private residence(such as balcony), and their second hand smoke is coming in your property. If you are lucky, you notice in time and close any widows you have open to avoid this nuisance. If however you don't notice in time, you now have 2 options.

For the smokers here, understand, the problem isn't that you smoke. The problem is that your actions cause harm to others. Once you are made aware of that, it should be your responsibility to find a spot where to smoke where it doesn't harm anyone.
To clarify on what my opinion of a nuisance like this would be."Daily prolonged repeated episodes".Essentially meaning, anyone smoking in a single spot, repeatedly and daily where their smoke comes in your property without permission.So a person waking somewhere in the street, even if everyday, would not count, as the smoke would only persist for few seconds.

My family has lived on a private farm for the majority of my life. However, an adjacent plot of land with an old barn on it recently changed hands, and the owners have made it into a rustic wedding venue.
With that comes crowds of people and loud music on nights when there used to be nothing out in the country but quiet.
But recently, the wedding photographers have been using our property for their wedding photos. They have actually been on our property taking the pictures, as well as using our property as a background (we have an amazing sunset, it and the privacy were the main reasons for living here). They have even moved things on our property without our permission so they could have better pictures- I.E. towing a tractor out of the way.
There is no public space near our property except a county road, three hundred yards away, and up until now, this "wedding barn" was private space too. It's just that they let a lot of people on it now, and they aren't respecting any boundaries.
What can my family do?
Update- Apparently the reason my folks are not pursuing this aggressively at this point is that they are in negotiations with another landowner to secure an adjacent 40 acres, at which point they will begin planting a pine plantation, effectively blocking the view from the wedding venue and providing some sound dampening. They are playing it cool with the sheriff's department right now because the venue owners are very very close friends with the sheriff and they don't believe they'll be given a fair shake unless they have a MOUNTAIN of evidence, which they are compiling with written communication and trail cameras. Once the evidence is collected and the land deal is completed (approximately around the end of the year) my parents will then send a C&D via their lawyers office and go from there. Thanks to everyone for the good advice.

Obviously the agent is trying to make a sale here. However I'm definitely not a legal expert, I'm new to the state, and have never owned a pool. There's a tall fence in terrific condition entirely around the pool and no one can get in without climbing over. I can understand being held liable if we didn't maintain the fence or left the gate open, but the idea we would be liable for a trespasser being hurt after climbing over our fence or breaking down the gate seems crazy to me.
I don't want an umbrella policy if I don't need it - I'm worried it would actually attract potential lawsuits, if someone DID get hurt and then somehow found out I had it.
Is there any truth behind this agent's claim? Or anything else I should know about attractive nuisances in Texas and protecting myself?
Coming up with some neat locations primarily for a play-buy-post/open world rp fantasy city - somewhere the characters could actually interact with cool stuff and roleplay among themselves apart from drinking ale in the tavern.

I don't want to step on anybody's toes here, but the amount of non-dad jokes here in this subreddit really annoys me. First of all, dad jokes CAN be NSFW, it clearly says so in the sub rules. Secondly, it doesn't automatically make it a dad joke if it's from a conversation between you and your child. Most importantly, the jokes that your CHILDREN tell YOU are not dad jokes. The point of a dad joke is that it's so cheesy only a dad who's trying to be funny would make such a joke. That's it. They are stupid plays on words, lame puns and so on. There has to be a clever pun or wordplay for it to be considered a dad joke.
Again, to all the fellow dads, I apologise if I'm sounding too harsh. But I just needed to get it off my chest.
Neighbor doesn't like that we built a deck. (FWIW it was permitted, inspected, etc.)
He used to be a normal neighbor, but we put a deck up and he went nuts. Started bad mouthing us to other neighbors, papered over his windows, replaced social justice signs in his yard with 'owner is armed' and other gun signs.
About 3 night / week he will spend 1-4 hours between midnight and 5am standing at the base of our driveway tossing a shovel up in the air and letting it clang down in the street. This is by our bedroom window, it keeps us up at night.
Sometimes it will be some other activity. For example, taking out the trash, spilling the bin into the street, cleaning it up loudly, but then bringing the bin back to his house. He'll repeat the whole dance until his session is over.
He won't be approached, just turns and goes inside if we come out to confront him. He has no nearby relatives or acquaintances that visit. He's divorced, probably in his 70s, and lives alone.
We called the cops twice. They come out, but can't do anything without evidence. He claims he's being discriminated against for being a night owl. After all, he's only taking out his trash, or edging his grass.
It went on for two months, we put up a conspicuous camera and he stopped for three months, but now he's back at it. That's a long time to be mad about a deck. We have fifty or so hours of footage of this guy just dropping garden tools in the street at 3 in the morning.
Before we go to the police with documentation... what is he guilty of?
Does this meet the bar for harassment under WA law? If so, the police will handle it.
If it can only considered private nuisance then we have to go to court to get an injunction against... idk what.
It might not even technically clear the bar for a noise violation in our city since shovel throwing sound is short and intermittent. He would need to throw the shovel 90 times in an hour to clear that bar. His actual rate is more like one throw every 1-5 minutes.
What to do? Persistent menacing for months on end is getting scary.

When everyone was off the Icarus Leo kept the introductions relatively short because he was going to be a little busy today. The first thing he asked was Fel to take him to the weapon that Tei used, because it was something that he wanted to see for himself given her description of the runes. Which is how he found himself in his testing room with a dozen or so large crates from the Venomara vaults, some left outside as they were too large to be brought in.
Although Leo was intending to only inspect the item before leaving to deal with the captured dragons and whoever they sent to negotiate for them, his mind was currently stalled at the enchanted sword that Fel gave him.
The sword was a double edge, gold and silver, three foot long, and overly ornate gilded blade. It was the definition of extravagant with runes covering the entire thing, but these runes were vastly different from the ones that he could make. Unlike the smooth shapes that faintly glowed blue, these runes were sharp and rigid shapes that had a yellow tint to its glow, and if he didn't know any better they seemed to almost resemble Celtic runes.
The runes didn't have any sort of visible connections, which was just further proof that it worked off an entirely different system, but that is not what caused his jaw to hang as he gawked at the inscription on either side of the blade.

I work for a company that specializes in making tools for marketeers that help build personals based on behavioural data.
While I realize that our tools help businesses direct their message to relevant users, I also feel like I'm a part of a machine that works by invading peoples private lives. No one likes ads. Everyone just endures them. It's disheartening to know that all the effort that goes into building our message is simply a nuisance to lost people.
I've seen time and time again that management and clients have totally unrealistic expectations. It's a sickness within the game. And a lot of people can't or won't be educated.
I just feel like most marketing is totally sugarcoating every message and ignoring all the issues a product can have, that can easily be addressed in a constructive manner. So much copy is just overly happy crap filled with superlatives and shitty optimistic "fun" tone of voice. I feel like the whole game is talking down to people.
Help me find my way again. I know marketing is important. I love educating people. I love being curious and creating sincere content. I find it hard to justify the whole data collection and spewing content into people's private channels of communication.
I have had this game since I preordered the founders pack. I did not get in it until last year as a daily player but since I have become a daily player I finished all the storm shields and have all but twine fully AFK kill style. I do not dupe or buy traps but have had players give me some stuff. I have played through the full quest log with only the play with others to finish off. We all know why this one is so hard. I enjoyed the fight and killing play style until twine. Then it became harder to get wins on missions, like it should be, and even harder to replace trap mats to play more missions in twine. Pubic matches like any game has its ups and downs with players but I always block those that are toxic and go about my game play. I have seen and learned different styles of playing the different missions. I played different styles depending on the mission and how I feel. In public I usually will go with what the others are going with. Now since I have little to do in the game I have been working on AFK / Jailing / and more effective no kill style basses. I do most of my mission in private I might add. I am an adult so I like the challenge it gave me. I enjoyed it and have gotten pretty good at it. Yes I can set spawn kill traps, kill tunnels, and shoot the husk but you can only come up with so many ways to do this that I found fun and before i run out of mats for those traps that may or may not kill the husk. Plus I should add I had an accident that limits the use of my hands and to much use causes pain in them so the so called afk style gave me a chance to prolong my game play with less pain by resting them and watching my build do what I took the time to develop it to do. Protect the objective like the mission told me to do.
With this said i am at a loss for a lot of you still say that AFK build or jail build is a problem. Do I tell you that killing husk is a problem or tell you not to use traps or how to play the game you bought. Nope! Stop trying to control how others play their game it is their game. Also Epic if you are not going to add content to this side just leave it alone because the problems you seem to work on the most are things that most do not see as a problem but more of a nuisance at best most of the time.
The news letter even state that some players like letting their walls do the work, well ya that is what walls do keep things out. Otherwise you should have just made us have traps that place walls with the trap then recyc

This is going to be a literal list of everything I can recall because I so badly need to get it all out. Recently posted an update about our situation too but left out some stuff and of course more stuff to report. Iβm about 4 months PP and anxiety is crazy still after all this drama, moving out of in laws house in a little over 2 weeks and I am SOOO ready. So for everyoneβs amusement, here we go.
21 weeks pregnant, we find out LO is a girl and have some ultrasound photos. MIL shares our daughters full name on social media without our consent and before Iβd shared with my own family.
We decide that Iβll be using a birth center and make the necessary calls/do paperwork. MIL insists I will want an epidural because I wonβt be able to cope essentially (coming from a woman who never went through labor with her one and only kid). Jokes on her, I didnβt need nor want pain relief and there wouldnβt have been time anyway.
First prenatal appointment at said birth center, she insists on being there and makes the entire appointment about herself by wearing her breast cancer mask (already in remission for a year or so) and talking about it with one of my midwives. At this appointment she records my LOs heartbeat on her phone without my permission and never does share it with me. After the appointment she tells DH that SHE will be sharing all prenatal appointments with him and since he went to the last ultrasound it was her turn at the next one. That shit got shut down fast and she was never invited again.
31 weeks pregnant my next ultrasound comes up, I donβt text her the photos this time so she canβt post them. When we get home I show them to her and she takes them to βshow her parentsβ. Next second theyβre all over social media.
She decides she will be primary childcare, as well as caring for our newborn as she sees fit. She tells us if we put the changing table in another room sheβll take LO when weβre asleep and change her but if it stays in our room she wonβt do that. Umm firstly no thanks and secondly what would be the issue of changing her in our room? Something to hide? Creepy af. We wonβt allow either of these things.
She would text DH after each prenatal appointment asking things like my weight.. what?? Yes my weight is super important and not the health of myself and LO. More annoyed she would ask him and not me since itβs my medical info not his.
