So there are bills currently in legislation that among other things, ban non-competition agreements and implement the Uniformed Trade Secrets Act in Massachusetts.I'd like to hear what you think because I'm a bit torn. I'm studying law and I like to hear other's opinions on matters. I have no more stake in this claim as any other employee residing in Massachusetts.
For those not educated in law, in laymen terms, the Acts (H. 4082 and H.4045), one of which is sponsored by Governor Deval Patrick, would ban companies from obstructing an employee's opportunity to look for work if they leave their current employer. In almost all companies currently, when you are first employed you sign an agreement that says "you will not be employed by any competitor of 'Current Employer' within X amount of months or X amount of miles in relation to HQ".
Furthermore, the current legislation protecting Massachusett's employers trade secrets' is the ability to punish individuals that knowingly leaked private information that was only known to a limited amount of people in the company. This protects, primarily small businesses from having employees go around telling competitors, in particular, about recipes, techniques, negotiation strategies, etc. So joining the other 48 states that currently implement the Uniformed Trade Secrets Act is something of an insurance policy from employees leaving companies and using unqiue information that was given to them from their past employer for the benefit of their employer and the demise of their past employer.
Governor Deval Patrick looks to create an environment that would increase competition in the workforce, and subsequently attract a more talented workpool. States like California limit the degree of which non-competition agreements are allowed, as would Massachusetts. California is constatnly referenced as a barometer for entrepreunership and job growth. However, the current legislation in Massachusetts may make it uniquely diverse in its ability to maintain job stability and "sorta" competitive company creation.
