YSK: The NLRB is a government organization that you can report your employer to for violating labor laws. Please read my whole post.

The National Labor Relations Board will take your complaint anonymously. If you can provide proof that is even better. One of the things that bother me the most is employers having rules that you can't discuss pay when it is a federally protected right, it's even written in my employee handbook no discussion of pay between workers and I have seen people get chewed out and written up for it. Another thing that is federally protected is starting a union, you don't have to be sneaky and slither around asking your coworkers about a union and you can't be fired for it. The law is on your side.

I encourage everyone to truly educate yourself about your rights and to exercise those rights by sending a complaint to the NLRB because they WILL send out a representative to investigate. It seems to me that this organization is the real deal and will aggressively defend your rights as a worker.

Professional Employer Organization Help

My nonprofit organization is transitioning to use a professional employer organization, known as a PEO (TriNet), for its payroll and benefits next month. I am so scared this will impact the eligibility of my last two payments before loan forgiveness once the COVID pause is over. I have no doubt our Executive Director will sign my ECF indicating I work at a nonprofit organization full time using our recognized EIN, but on our call with TriNet today they said our W-2s and taxes will list TriNet, which is for profit.

Who has navigated this situation? I am part of our senior team navigating this transition, so what should I ask of TriNet to ensure our payments remain qualifying and recognition that we are a nonprofit organization? I would also like to advise our staff, as I know at least five other employees at my organization who are also pursuing forgiveness.

Mostly title, but wondering if it's typical for companies to make it known when someone is promoted to a higher level in their org. My org seems to want to keep everything a secret, which just causes rumors and drama IMO. Why not celebrate someone earning a promotion? I get people might get butt hurt, but I don't think that should matter.

Should I work for a company that uses a professional employer organization (PEO) for payroll?

I live in California and a company based in another state has offered me a remote position but they want me to independent contract (1099) for the first 60 days. After the contract is done for 60 days, I will be a full time employee - is what they told me. At that time, my payroll checks would be coming from a PEO. I asked why they do it this way and they stated that the company does not want to pay California payroll taxes. Is this normal, is there an angle here for them?

I am new to this type of payroll and the first thing that comes to mind is a bit of a red flag. Maybe it is smart of them to 1099 me because they can test my performance for 60 days and let me go if they want to? I also read that a PEO company can charge a fee to me and if the company grows that fee can grow? Should I be asking for a higher salary to compensate for this?

Another idea came to me about how the recruiter is involved with all of this and how do they get their money? Does the recruiter also work for the PEO company and do they get a cut of my salary for their commission?

The people at the hiring company all seemed really nice and legit but when this pay stuff came up I started to question it a bit. The position sounds really cool but I am a bit skeptical.

Should I move forward with this job offer? What would you do?

Is it illegal for a for profit organization to use the same EIN (Employer Identification Number) as an Internal Revenue Service (IRS) 501(c)3 nonprofit organization?

That is the for profit opened bank accounts using the EIN of a 501(c)3 tax exempt entity.

Is this a violation of any IRS rules? or any laws?

TriNet a Professional Employer Organization (PEO) as co-employer

My wife's company is in the process of exploring switching to TriNet to manage their benefits and payroll (one of the HR people is her friend so she found out). My wife is on a H1B, so will this be a potential problem for her with immigration? As far as she heard, Trinet will be used for benefits and payroll where on the W2, TriNet will be listed as the employer. Advice about changing jobs after a long stint at current organization and negotiation with future employer

A bit of background info: I have been in my current organization for 10 years now and have held mid to senior positions. It has been good 10 years and I got to learn a lot, however lately I’ve started to feel like I need a change due to many reasons most important of which is needing a new perspective and challenges.

In these 10 years I have not interviewed with anyone, so as you all can imagine, I am out of touch with how to approach the overall interview process. I got one offer a few weeks ago, which I declined since I was not fully ready to switch right away. I have a few more interviews lined up and things are going well so far. My questions are these and if you can offer some advice on it will be appreciated:

  1. How much time can you reasonably ask for before you reply to an offer? Since I am going to be interviewing at a few places, I would like to wait for some progress before accepting or declining one. Is the expectation to answer in a day or two?

  2. What reason do you give to a recruiter for asking more time? Can I just be honest and tell them I would like to wait to see how my other interviews go?

  3. Once I accept an offer, will it be too bad to decline it after? Does this happen often?

  4. I would like to take a vacation before I resign in my current organization. I have too many days accumulated. Is it reasonable to ask for joining in 4-5 weeks (3 weeks off plus 2 weeks notice)
