Questions about Bobby Seale.
I just watched the Netflix movie 'The Trail of the Chicago 7' and I tried to look up one pressing question I had throughout the movie, but couldn't find an answer. Seale's attorney couldn't travel due to his health, and the judge wouldn't allow him to represent himself. I understand why Kuntsler could not represent him, as it would be an issue for his appeal and would have definitely made them look more like a group. What I don't understand is why he didn't hire another attorney when their motion to change the date of the case was denied. Was there no other attorney that the Black Panther organization could afford, or is there something I don't quite understand about the way a court proceeding works?
Disallowing him counsel, and disallowing him to represent himself should be a breach of the constitution. Thankfully he was given a mistrial, but why was the judge not held accountable for stripping his rights away? Why have I not heard of Judge Hoffman being put on trial for breaking the law in this manner? Has anything been done since to try holding members of our justice system accountable in the last 50 years?
Gagging a defendant should lead to a lot more than a mistrial. Even ignoring the obvious racial hatred fueling the action, the Judge stripped a man of the ability to have a fair trial, and should have been prosecuted for it.
