I got my MEE breakdowns. I got two 2s on the ones that I wrote wrong for the black letter law and missed some key terms, the corps one and the family law one. I got a 4 on torts and 5 on the anti-lapse one, so its probably not because of IRAC and my analysis but because that I wrote wrong the key terms and stated unclear for the black letter law that causes me getting low scores for the MEE. Any recommend methods to improve?
I have been doing everything Barbri has told me to do, but it seems like Barbri is expecting me to remember rules after exposing me to them maybe twice. I thought Barbri was supposed to be comprehensive, but it doesnβt seem like itβs any good at all at helping me memorize the law. Is there something else Iβm supposed to be doing? And can someone recommend to me a way to memorize all these laws, whether itβs a program, or making flash cards, or whatever? Thereβs so much to memorize that it feels impossible, yet somehow people do it, so thereβs got to be a way, even for someone like me with a notoriously bad memory.
Dear Friends, I am foreign lawyer with a US LLM. I am taking the UBE (NY) this July. For the 7 MBE subjects, I have plan on reading the Barbri outlines+Conviser and then do BarMax for practice questions. For the MEE Essay subjects - What source/information do you recommend for black letter law (Rules, Definitions, Elements, Exceptions etc) what I can memorize? Appreciate your recommendations!
I heard Barbri has a Black Letter Law outline, similar to the Studicata Attack Outline. I was thinking about buying the Studicata Attack Outline but if Barbri has one--does anyone mind sharing it? I'm not a flash card person so a pre-made list would be great for when I'm out but want to review!
I am just absolutely struggling. I know the black letter law. Truly. I do. I do black letter law question sets, go 12/15, or better every time. But then, I hit the actual MBE questions and just shit the bed. I get it down to two answers, and pick the wrong one. Itβs killing me.

I'm way behind on MEE materials. I've done all the lectures in Barbri, but barely any essays. In this last week, what would be a higher ROI, reading and powering through as many essays as possible or reading outlines and making flashcards for MEE subjects?
I'm pretty solid on MBE questions (around 68% overall on adaptibar after 1100 questions)
I know some of you will tell me to use my own outlines and just to assure you, I will. But it has been recommended to me by a prior law student to get a commercial outline just to help you see the black letter law. So what is better, Gilbert, Emmanuel, Examples & Explanations? Thanks for any help - I start school next Wednesday.

Hi, Iβm new here. Taking the CA Bar this month. Please, does anyone have any tips on reviewing. Iβm taking Barbri and Iβll be finishing my last lecture tomorrow and I want to start reviewing all subjects. Iβve doing MBEs, averaging 58-67s but I know havenβt really gotten my black letter law down. I dont want to do theCMR it takes way too long. I have critical pass flash cards on my phone. Can I learn solely on those?

We've seen a few cases of hemp providers being arrested for what LEO assumes to be marijuana. This leads me to thinking, if it so effective, why wouldn't every blackmarket distributor mail their packages of marijuana with note of the hemp bill and current regulations along with hemp labs to seem legit?
It seems like the perfect idea, you have .03 product already testing hot with faulty testing measurements. If the paperwork is our saving grace, then I'd be hard pressed with the current quality of product that looks and smells nearly identical to best offerings of any variety that marijuana would be waived off as well.
I think it's time that we openly address the failings of LE from even before the girls were found.
There is a laundry list of actions taken by Tobe and others that undoubtedly made it harder to catch who did this, that put the girls at further risk by assuming that they had ran away.
One of my first questions would be : 'What made you think the girls had run away that day? Do you realize that by considering them to be runaways and not taking it seriously, you opened an avenue for the killer(s) to make good their escape?'
Many of us now feel that local LE alienated FBI, GBI and others by insisting on their backwoods tactics and relying on unproven alibis and criminal informants and failing to use every resource at their command on the cold night that the girls went missing.
There are many articulate, competent people on this Sub that are great writers, creative thinkers and who have extensive knowledge of the case that could write a letter on behalf of the public, exposing the inadequacies and the failures of LE starting that night. There is plenty of documentation to show that they failed to take it seriously when the girls were reported missing, in spite of the fact that they knew the extent of the meth manufacturing in the area and the people involved who hung out at the trails and bridge for privacy.
LE has taken a tight lipped stance and we all understand it's dangerous to release too much information. But, we are nearly 5 years in and it's time to talk about the truth and to hold them accountable for getting justice for Abby and Libby. No matter what the girls were up to that day, they didn't deserve to die. What they do deserve is a Law Enforcement community that is 100% dedicated to transparency and to finding their murderer(s), no matter who was involved and even if it exposes weaknesses and criminality within the department. DC questioned who the girls were meeting that day, who their associates were and what they were planning. By doing so, he seemed to imply that the girls put themselves in danger. He may not feel that way, but his words opened a window into his thinking.
Collectively, those of us who visit and write on this Sub have amassed a great deal of knowledge and information. Our primary function here is to find who did this to the girls and why. So my husbandβs mother came down to visit to see my youngest son when he was a newbornοΏΌ and showed her assοΏΌ!!! You could tell by her body language and facial expression that she was not happy with the way my son looked, iβm not sure if she was mad at the fact that he looks like me or his father but whenever anyone would say that he look like his father she would catch an attitude but in a very subtle way and try to play it off. She stood in the room for 10 to 12 minutes three times basically back to backοΏΌ while he was sleep! Two days later, she kept repeatingβ you look just like your brother β over and over and over again without having anything else nice to say! Yes siblings do tend to look like but at this point I knew there was an issue when my husband caught on to what she was doing and he doesnβt see shit ... ever! οΏΌοΏΌοΏΌNow since Iβve cut her off for the past year & not having any contact with me & the kids, she wants to say that he now looks like his father when all it is is that he grew went to his features and look the same the whole time! I know many are still banking on the "lump all gains that got withdrawn to fiat together and hope everything else goes unnoticed" method that has been popular in the past. But I also know many take it more seriously, with spreadsheets of all trades showing cost basis, etc.
Be honest, do you have a plan for next year's taxes and what is it? And if you're planning to do it the "lazy and not up to code" way, are you concerned of all those trades on whatever Dex coming back to haunt you?
If you're planning to file as "by the book" as possible, what's your system to keep track of all these various trades and whatnot?
Hi all! I took the LSAT three times. My last test score was a 157 (August 2021) and my first one was a 138 (May Flex 2020). After 7Sage, Powerscore, LoopHole by Ellen Cassidy, Khan Academy, and 12 private tutor sessions later, I did it. This test will consume your time and money but the reward outweighs all the triumphs of the LSAT. I fought tooth and nail studying for this test while working full time. You can do it too. Youβve all been amazing and incredibly helpful. I wish you nothing but success and happiness in your future endeavors.

I am doing research on the differences on a few different business contract types. Currently I am researching the definitions and differences between a Memorandum of Understanding and a Letter of Intent.
As far as I can tell, both agreements are not legally binding / enforceable if the language used is carefully crafted to not use "agreement" but "intent". In additions, for some jurisdictions all parties have to act as if the documents are based on intent and not agreement.
The only substantial definition of difference between the two documents is merely in terms of practice and generality. LOI documents seem to be drafted at the beginning of the negotiation to establish base negotiating parameters and seriousness in the ongoing negotiation and an MOU seems to be drafted just before a legally binding contract is singed and ought to be more in depth and outline the major negotiation parameters that will be finalized in the agreement.
However, as both documents are not legally binding if drafted with the correct language and assumptions by all parties, are the absolutely interchangeable? Can an LOI be used in place of an MOU and vice versa skipping and extra document that needs to be agreed upon?
If this is the case, can anyone speak to the corporate industry norm for the usage of an LOI and MOU?
I have reviewed a lot of boilerplate, templates and commentary on both documents and some differences but I cannot find any definitive description of when to use either and I am left with the inference that they are basically the same but only used as a matter of expectation in specific stages in a negotiation.
I would greatly appreciate any insight.

Studying for the bar, trying to look at different ways to approach the subjects.
Presently, my favorite is one for hearsay exceptions for unavailable witnesses: FFSAD, as in "Ff (like a sound effect), Sad you couldn't make it to court." Former testimony, Family/personal history, Statement against interest, Against Person procuring D's unavailability, and Dying declaration.
I took Antitrust this semester and was surprised by how much I've enjoyed it. Most of my classes next semester are seminar courses, but I'd love to be able to take at least one black letter law class as well.

Iβm writing this after the Tampa Bay Rays got fucked in the playoffs today. Basically they were going to score potentially a go ahead run but the ball ricocheted off of the Red Sox player, going out of bounds. So, instead of the runner scoring, he instead got moved back to third because it was ruled a ground rule double. While everyone agrees the rays got shafted it was still the right call according to the rules of the game. However, the spirit of the rule would be the run scoring because it makes absolutely no sense bad fielding should benefit the team.
While sports were the impetus for this post, I think this could apply to the real world. Technicalities have caused innocent people to be screwed (think entrapment by police) where they are guilty by the letter of the law but actually innocent by a common sense knowledge of the law.
This has also led to a lot of loopholes, for example in the tax code, with rich people being able to use technicalities to pay little to no taxes. In this new system, a judge would rule that the loophole doesnβt align with the spirit of the law.
However, there are some limitation admittedly. For instance in a society with many systemic problems like racism or homophobia, injustices could be exacerbated with prejudiced judges changing the laws meaning to incarcerate innocent people or free guilty people. So, a relatively just society is a prerequisite for this system.
Edit: I shouldβve said this in the OP, but my definition for spirit of the law would be: Discerning what the original rule makers meant when writing the law or what they wouldβve ruled in a certain example
