Every once in a while, we hear some news of Niantic or the Pokemon Company doing some legal maneuvers in China to facilitate the eventual launch of Pokemon Go there....and yet it hasn't happened in 4 years. So....what's up? This is a post detailing the technical issues surrounding ONE particular aspect of Chinese law --mapping laws-- which in my opinion, create the some of the greatest technical and financial challenges for Niantic.
ATTENTION: Both Chinese law and the politics surrounding China can be touchy subjects. Discussing Chinese politics is NOT the purpose of this post. Instead, I will only discuss ESTABLISHED Chinese law with minimal references to the political implications of said laws. That said, I have only a passing familiarity with Chinese law and I do not claim area expertise in all of the technical details I present here. You have been warned.
Chinese mapping law
In a nutshell, the Chinese government prohibits the publication of geographical data about its territorial land, water, and air. The operant word here is "publish" -- to publish map data means to make it publicly available. That means no unauthorized creation/publishing of maps/map data or geotagging of certain items (notably photos).
In short, any application or venture that tries to create a publicly accessible map of China is going to run into legal trouble (to the tune of heavy fines). Things like OpenStreetMaps (basically, crowdsourced Google maps) and camera makers that geotag photos have run into trouble in the past.
Practically all the basic functions of PoGo break these laws. From the position of spawn points (arbitrarily chosen, but fixed-point locations that are broadcast by Niantic servers to everyone's phones) to the location/photos of PokeStops (again, broadcast by Niantic servers), to the location of the player's avatar (not broadcast, but locally available for all devices and to Niantic themselves), Pokemon Go is one giant exercise in violation of Chinese mapping laws. And of course, the recently launched AR scan feature is a huge no-no.
Obviously, though, it's not like China is completely without maps. There exist a small number of Chinese companies with the authority from the government to create maps of China. So Niantic basically has to collaborate with one of these companies. But before I get into what this collaboration would entail, I'll give a quick primer on how global positioning works.

Todayβs data shows a total of 56,786 new test results from both state-operated and privately-operated labs. 3,768 of those results are positive and 53,018 are negative. 20,947 of the results are from first- timers* while 35,839 are from people who were tested at least one other time in the past (excluding the previously mentioned first-timers). 6,402 of the retests are results (positive and negative) from people who have previously tested positive; these results are excluded from the FDoHβs positivity calculation.
The data shows 2,564 new cases (2,513 residents & 51 non-residents) with a calculated positivity of 12.23% from 20,947 tests (first-timers). The FDoH reports a positivity of 5.97% from 63,188 tests which may include people who have previously tested negative, but NOT people who previously tested positive. The average age (mean) of the new cases reported today is 36. There were 162 covid-positive emergency department visits reported today (160 residents & 2 non-residents) and 114 new hospital admissions (112 residents & 2 non-residents). Finally, there were 38 new deaths reported (38 residents & 0 non-residents).
* βFirst-timersβ are people who have tested positive for the very first time (though they may have tested negative in the past) along with people who were tested for the very first time with negative results.
