Wife’s divorce attorney served me Interrogatories form

My wife and I agree on all division of property and debt. She doesn’t really understand the process, and hired an attorney because she thought she was supposed to. Didn’t realize there were simpler options for an uncontested dissolution. I am self represented.

She has not been in contact with her attorney and he just served me with an Interrogatories form requesting a ton of documents, up to current date, when our agreed separation date it in 2020.

Is it normal to have to complete this with this in an uncontested divorce? I get that much of this might need to be listed in the agreement my wife and I sign. I am mostly worried that he is providing extra services that my wife (or both of us) may need to pay when it’s necessary.

Advice, pointers, all info appreciated.

Continue with interrogatories and garnishment or work with the defendant?

I wasn’t sure how else to word this for title. Short version is we just received word from the judge we won our civil case for ~$8k. We did this because this person offered to invest our money for us, promised to return it, and has yet to do so with an insane amount of excuses. He’s continued communication with us but claims our money is tied up.

Now that we’ve won our civil case against him I told him we’d begin interrogatories and garnishment. He said he can start by giving us a few hundred each month to start and possibly more as time goes on.

Is there any reason why I shouldn’t delay interrogatories and garnishment so long as he does in fact start paying us back? The judgment is good for 5 years. So the month he doesn’t I can always move forward with it.

I live in Colorado.

How much info to put in a response to Post Judgment Interrogatories

Obviously, I'll answer all the questions but also, I feel like including some context.

Specially, my law school (I'm aware of the irony) sold my debt to a lawyer who got a judgment against me when I was mentally incapacitated due to mold-triggered illnesses (I was literally re-learning the alphabet when I got sued and don't remember it even happening).

Fast-forward to now, he wants to know about my bank accounts (I own $6.23 in a savings account bc I'm too poor to have a checking account), etc. I was thinking of including screenshots of my dozens of medical diagnoses according to two hospital systems and a letter from my Chronic Fatigue dr about how I shouldn't move, stress or even think too much bc it can cause "crashes" which have a cumulative negative impact on my health. I also was going to explain that I didn't know the alphabet when I was being sued.

I thought this might make him not waste his resources and my time (which as a spoonie is even more precious) in the future and that if we ever get in front of a judge, it could substantiate my claims and that the lawyer should have been on notice about my health /inability to pay.

Idk what good that does really, I did borrow the money and go to school but I haven't been able to work since 2018 and as the saying goes, "you can't squeeze blood from a spoon."

The only litigation I ever studied was civpro -which was easily my least favorite class in law school (I wrote contracts for artists in my day). Any insight would be great!

Jason Shaesby "Interrogatories and Contention Interrogatories" We have talked about 3 a lot. I went back and took a second look at 1,2, and 4. Techs and Legal Eagles lets dissect 1,2, and 4

I am not a tech guy. I understand the basics so I would love to hear from the techs specifically in Regard to how these Interrogatories 1 and 2 might have come up in the Samsung case?(Remember these are from the Google case)and for any legal eagles out there Interrogatory #4.

Interrogatory #3 we all know has been ordered to be answered "Fully" by Judge Spero as a separate order from the court. I have focused a lot on #3 but after Jason Shaesby "Notice of Appearance" in the Samsung case I think the answer is here in the other 3 Interrogatories. Legal Eagles look closely at 4 It asks specifically for legal advice pertaining to the 912 and during the "Interparties Review" (IPR) at the PTAB. Discovery is going back to 2008 in Rogs 1 and 2.

Excerpt From court Order: JOINT STIPULATION AND ORDER FOR EXTENSION OF TIME TO BRIEF THE ISSUE OF INTERVENING RIGHTS (Local Rule 6-1 and 6-2) [Document image below]

Question About Divorce Interrogatories

My attorney gave me an example of the information requested in the interrogatories.

The income/tax/property sections were expected.

What I was surprised to see was the request for social media login information; profile, photo and posts. It asks for all websites visited and the login info. It also asks for a list of all people my STBXH has had sex with and their contact information.

He is going to be livid when he gets served with divorce papers. (He wants for us to live permanently separated because it is better for him financially.) When he gets a demand for all this personal information, I can't imagine how angry he will be and his reaction concerns me a bit. I am several states away, but I now have a worry about my safety. (Maybe I need to back off on watching ID channel.)

Is it normal in interrogatories to ask for so much personal information? My attorney says he can be held in contempt if he doesn't answer.

FL - A friend committed assault 40 years ago. The record was sealed, then expunged. She's being sued today for a traffic accident, and one of the questions posed in an "Interrogatory" is "list all crimes that you have been charged with". Does she need to admit to this crime 40 years ago?

EDIT: I found the answer via a simple legal look up. 943.0585.(6) very clearly states:

(b) The person who is the subject of a criminal history record that is expunged under this section or under other provisions of law, including former ss. 893.14, 901.33, and 943.058, may lawfully deny or fail to acknowledge the arrests covered by the expunged record, except when the subject of the record: [FOLLOWED BY LIST OF EXCEPTIONS INCLUDING "DEFENDANT IN A CRIMINAL TRIAL" BUT NOT INCLUDING "DEFENDANT IN A CIVIL TRIAL"].

(c) Subject to the exceptions in paragraph (b), a person who has been granted an expunction under this section, former s.Β 893.14, former s.Β 901.33, or former s.Β 943.058Β may not be held under any provision of law of this state to commit perjury or to be otherwise liable for giving a false statement by reason of such person’s failure to recite or acknowledge an expunged criminal history record.

There's a bunch of exceptions to the denial rule, including being a defendant in a criminal case. Being a defendant in a civil case is not listed as an exception. Therefore, it is reasonable to conclude that it is legal to deny an arrest in as civil case. This is true in Florida, but not necessarily true in other states.


So she has insurance, and her lawyer, the lawyer assigned by her insurance company, sent to her a list of "interrogatories" for her to answer. The lawyer will then prepare her answers and send them back to the plaintiff's lawyer. One of the questions is about her criminal history.

Also to note, she was not driving her car at the time of the accident. She had let her brother drive her car, and her brother was also listed as an approved driver on the insurance. Both her and her brother are older adults.

As I understand it, Florida has a Denial Rule which allows one to deny and not divulge an arrest covered under a sealed or expunged incident. Here is an excerpt of Florida Law taken from a Florida Lawyer's website:

Drafting interrogatories?

I have an assignment in which I have to draft interrogatories for defendants using FRCP and another using TRCP for any Enron case. Interrogatory #3

The Judge ordered Google over the weekend to fully answer Interrogatory #3! That should be coming out shortly and is in regard in part to claim 16 for which there is most likely no intervening rights and that is probably why the Judge wanted that answered. With that said, where is Googles answer or do they just intend to cut to the chase and settle?

Intimate videos in interrogatories

Can my stbxw ask for photos and videos I have taken with a girl I started dating after she filed for divorce that are intimate in nature?

Wouldn't the girl in the videos and photos need to give permission to release them?

What actions can I take to prevent her from getting these photos?

There was no infidelity before she filed so I'm unsure as to what relevance it has.

Deadline to respond to interrogatories

Starting a thread here! WG and JM had until Jan 15 2021 to respond to interrogatories set out by the Defendants, since June 2020. They've had a pretty hectic life these last few weeks, I am not sure if they even made it to their court date this past Friday! Nonetheless, I'm eager to hear the outcome from Friday's ruling!

Interrogatory Letter

I recently received a Letter of Interrogatory Illegal Drug Use, asking me a handful of questions asking for more detailed information about drug use and about certain possible conflicting statements I made during my security interview. Sample of Interrogatories

Hello everyone, Virginia here, Virginia Beach specifically.

So I own my own lawn care service company. I have a client who hasn't paid his bill and I took him to small claims court and won (he didn't show up).

He has yet to pay, so I filed a summons of interrogatories.

I understand this is so I can ask him questions that he will have to answer, other than his job information (place of employment, address, phone number, etc) what other types of questions should I/am I able to ask him?

I tried to look for some samples online but everything was either for divorces or in deeply legal terms that I couldn't understand.

Also, do these questions need to be on a sheet that I give to him so he can write the answers down? Or is it all verbal?

Responding to a DODCAF Interrogatory

I have received an Interrogatory from DODCAF asking for additional information to supplement my SF-86 and BI phone interview, both of which occurred months ago.

I have been perusing the 2020 Industrial Security Clearance Adjudications site and I am aware of the Adjudicative Desk Reference, so I have some idea of what the outcome of this process will look like, but I am unsure how I should respond to the Interrogatory.

My main question is: should I get legal counsel to assist me with responding to the Interrogatory, or can I simply answer the questions myself? And, more broadly, are there any "gotchas" with Interrogatories that I should be aware of? My concern is that, because I have not applied for clearance before, my naivetΓ© will harm my chances of getting a favorable decision.

Obviously I want to be completely candid in my responses, but I know that, for example, with the SOR they don't tell you that you can submit additional evidence to attest to your good character. In other words, I just want to know what I don't know about this step of the process.

Rule 11 did not seem to pertain unless I read it wrong because it says it does not deal with Discovery. Rule 56 does pertain and it is in place to prevent unnecessary, Costs, and delays. Judge Spero asked for Googles Full answer to Rog 3 remember?
