Hi everyone.. I was served paperwork yesterday. I’ve looked up the case number and it is in the system, however there’s no deadline or next steps or court date on there - just a statement by the plaintiff that I own her money (which is not true). What should I do? Can I file a motion to dismiss or demurrer myself or do I have to hire a lawyer? Thank you in advance!
There’s been a recent “anti-meritocracy” movement with Daniel Markovit’s “The Meritocracy Trap” and Freddie DeBoer’s “The Cult of Smart”, which has raised a difficult question for me: does anyone “deserve” anything? If my intelligence (in the sense of technical cognitive ability), my five-factor personality profile (particularly conscientiousness), and parental SES are the three greatest predictors of my success in service-oriented Western societies, and all are substantially related to who my parents were (with personality and IQ being substantially heritable and parental SES being parental SES) or are otherwise determined by events outside of my control (chance events, prenatal hormonal environment, early childhood experiences, mysterious and unidentified, unmeasurable “non-shared environmental factors”), then what does this leave me with in terms of “merit”, “desert” and “earned success”?
I didn’t choose my parents, my body, my neurology, or even my motivation to succeed (ambition, desire for financial rewards, the ability to defer gratification, etc, all seem to be substantially heritable and environmentally influenced), and if I have free will, it doesn’t seem to be doing much. What’s the political moral?
Well, if I’m taking the research on predictors for life outcomes seriously, it seems hard to justify meritocratic ideals—even if determinism isn’t true, because however free our will is, we appear to be starting at wildly different and hideously unfair places in life.
Is it really fair to let the spoils of a winner take all economy collect into the hands of the winners of various genetic and environmental lotteries? Wouldn’t this make John Rawl’s veil of ignorance idea more morally persuasive? That we should try to create a world such that if we were to be born into any body at random (which, so far, is the world we are already in) it would be as good as possible to be the person we happened to be (which, obviously, is anything but the world we live in and which we could do a lot more to bring about than we are doing already).
So, why not a Rawlsian campaign of mass redistribution? This doesn’t have to conflict entirely with capitalism, mind you—we could just find whatever economic system engineers wealth the best, and then maintain the highest level of social spending compatible with not causing systemic collapse (maximum sustainable equality).

Whenever I draft a document that references a First Amended complaint I define it and reference it throughout as “FAC” (as every attorney I know does).
Currently drafting a demurrer to a First Amended Petition for Writ of Mandate and I did the same, defining it as “FAP.”
I just now realized I’ve written FAP, FAP, FAP everywhere throughout this document...

If you feel it's appropriate to share NSFW jokes with your kids, that's on you. But a real, true dad joke should work for anyone's kid.
Mods... If you exist... Please, stop this madness. Rule #6 should simply not allow NSFW or (wtf) NSFL tags. Also, remember that MINORS browse this subreddit too? Why put that in rule #6, then allow NSFW???
Please consider changing rule #6. I love this sub, but the recent influx of NSFW tagged posts that get all the upvotes, just seem wrong when there are good solid DAD jokes being overlooked because of them.

I am currently in the hospital. I had a back operation yesterday. The surgical nurse came in my room and started asking questions about my back. She asked me if I had any falls during the last year. I responded just one. It was after summer.
She laughed and said in 20 years of doing this she never was told that joke.
Had to ground him until he could conduct himself properly.
