I was watching a video and a case was mentioned. I believe the person said U.S. v. Goran. It is a 1946 case in which someone in the U.S. military was arrested under the Espionage Act for giving the British the US troop ship schedule. Does anyone have a link to this case or does someone know if it is "Goran"? I am not sure I heard correctly, and nothing is coming up. Thanks!
I looked them up and their definitions are both "intentional wrong doing". I failed this exam last time and had several questions where these were two of the answer choices
Last year, or maybe the year before that, scienters were looking into that one thing, trying to figure it out. I saw an article a few months back saying that they made some progress, but at the time there was no answer, just a bunch of this, that, and the other thing.
Did they ever figure that one thing out? Was it what we thought it was going to be?

Discovery has finally concluded in the "funding secured" class-action suit, In re: Tesla Securities Litigation, No. 3:18-cv-4865, N.D.Cal.. The lead plaintiff says the evidence is indisputable as to key questions in the case, and therefore those questions should be decided by the judge at a hearing on March 10, rather than be put to a jury at the trial in June.
Accordingly, yesterday the lead plaintiff filed a motion for partial summary judgment as to the elements of falsity, scienter, and reliance. Most all of the new information that came out in discovery is redacted (at least for now) (but not effectively, see updates below), but it seems not to have been too helpful for Tesla. Plaintiff summarizes the situation as this:
> From August 7, 2018 to August 17, 2018, Muskβs tweets that he had a fully funded proposal to take Tesla private at $420 per share with confirmed investor support roiled the market for Tesla stock and other securities. No part of this unconventional announcement was true: Musk had not secured funding to take Tesla private at $420 per share nor confirmed investor support. Furthermore, Musk knew that, as of August 7, 2018 when he impulsively tweeted to over 22 million followers, his going private proposal was little more than a preliminary, half-baked concept. When the truth about the haphazard and misleading nature of the statements was revealed, Teslaβs investors lost billions of dollars. Based on the evidentiary record in this case, no reasonable juror could conclude that the August 7 and August 13, 2018 statements were not materially false and misleading, that Musk did not make those statements with scienter, and that class members did not rely on those statements. Partial summary judgment should be entered in Plaintiffβs favor.

I don't want to step on anybody's toes here, but the amount of non-dad jokes here in this subreddit really annoys me. First of all, dad jokes CAN be NSFW, it clearly says so in the sub rules. Secondly, it doesn't automatically make it a dad joke if it's from a conversation between you and your child. Most importantly, the jokes that your CHILDREN tell YOU are not dad jokes. The point of a dad joke is that it's so cheesy only a dad who's trying to be funny would make such a joke. That's it. They are stupid plays on words, lame puns and so on. There has to be a clever pun or wordplay for it to be considered a dad joke.
Again, to all the fellow dads, I apologise if I'm sounding too harsh. But I just needed to get it off my chest.
I'm a bit overwhelmed by the response to my post about a possible new website. ALL of your comments have been helpful to me. I can't respond to all individually, but let me address a few issues here before we get to the scammers.
Demand: As of right now, 93Β½% of the SBs who responded to the poll said that they'd try a new website, and 86% of SDs said that they would. It seems that the demand is there.
Two-Sided Market: Well, sort of. If the SBs are there, the SDs will come.
FOSTA/SESTA: Yes, this is a problem, but not an insurmountable one. Without getting too far into the legalese, both laws require scienter, a legal term which, in this context, would require that the operators of such a website knew that it was being used for trafficking. The preliminary legal opinions I have obtained (other than mine, of course) tell me that there are ways to implement a sugar website. Still working it out, of course, it's complicated and will take some time.
Yes, Backpage was closed down and it's owners charged with crimes. But sugaring is very different from what Backpage was. Apparently there was evidence not only that Backpage was hosting advertisements for child sex trafficking, but that the owners participated in writing some of the ads and otherwise assisted the traffickers and profited from the trafficking of children.
I would add that SESTA also implicates the First Amendment right of free speech, and it's my understanding that one organization has already commenced litigation on this point.
Website Hosts and Payment Processors: Like FOSTA and SESTA, the are a number of ways to solve this potential problem, including payment processors outside the U.S. In some ways, it's somewhat similar to the difficulty that online casinos have had in this space. Yes, I know that this is fundamentally different from online casinos, just saying using it as an example that problems with U.S. banks being hesitant to provide these services for some types of businesses is not insurmountable.
But, of course, there are other challenges; and right now I'd specifically like to hear your views on how to screen out scammers and the like. There seems to be a lot of sentiment in favor of verification, both of identity and (for SDs) income .
Financial Verification: I'm not sure how one would accomplish this. Take income verification for SDs. No SD is going to be interested in providing bank statements, tax returns, or any other similar documentation. In fact,
