Christopher J. Belter arrived at Niagara County Court Tuesday with the knowledge that his conviction for r8pe, s3xual abuse and s3xual assault, crimes he committed against teenage girls in his Lewiston home, could send him to prison for eight years.
Instead, Judge Matthew J. Murphy III placed Belter on probation for eight years, saying a prison sentence in the case "would be inappropriate."
The sentence stunned Belter's victims and outraged the lawyer for one of them.
"Justice was not done here today," said Steven M. Cohen.
"He is privileged, he comes from money, he is white," Cohen said of Belter. "He was sentenced as an adult, appropriately. For an adult to get away with these crimes is unjust."
Asked for his client's reaction, Cohen said, "She's in the bathroom throwing up."
Murphy had previously decided that Belter, now 20, would not be granted youthful offender status, although the crimes occurred when he was 16 and 17 years old. He said he struggled to come up with a just sentence.
"I agonized, I'm not ashamed to say I actually prayed over what the appropriate sentence would be," Murphy said. He said his probationary status would be "like a sword hanging over your head for the next eight years."
It was not the first time a judge had granted Belter probation. Now-retired Judge Sara Sheldon, made a similar warning to Belter in 2019. Sheldon placed Belter on two years' interim probation to give him a chance to earn youthful offender status, which would have limited his sentence to four years and would have prevented him from having to register as a s3x offender.
Sheldon predicted at the time that Belter would find it hard to comply with all the rules and restrictions she imposed, and in fact, he did not.
Belter, who now lives in the City of Lockport, admitted last month that he violated probation by installing software on his personal computer to bypass a content block that prevented him from viewing p*rn*graphy.
