Iβm a tenant with an AST agreement with a leaseholder in a building of 3 flatsβ¦. As of the 15th December, the freeholder has been granted permission to build 2 more stories on top - making 5 in total. We are the ground floor flat. This building work is going to disrupt us massively - we will lose access to at least part of the garden as any scaffold erected will need to be in contact with the ground (the garden access is through our flat only) and of course block light, create noise and dust and generally ruin our quiet enjoyment of the property for the remainder of our contract, which is 10 months. My partner also works from home and trying to work from a building site isnβt going to work. What options do we have here? Our contract is with the leaseholder, we have no relationship with the freeholder at all. Does anyone have an idea of where to go from here? Many thanks.

This is a bit of a convoluted issue, I will try to keep simple. I live in England.
About 18 months ago, I purchased a leasehold maisonette in Birmingham UK. The layout of the dwelling is very peculiar. The top floor of the dwelling contains the master bedroom. Above the master bedroom, is another lease hold property. The footprint of the dwelling above means that they have a balcony directly above the ceiling in our master bedroom. During autumn 2020, we noticed that the room began to suffer a water leak. The leak was coming from the ceiling on the "balcony part" of the dwelling above ours.
I notified Citizen, which is Birmingham's social housing company who own the free hold. At first, they were quite good. They sent out a man to visually inspect the issue above. A few weeks later (Jan 2021) I received an email saying that they had found the issue (rubbish had blocked the gutter), caused stagnant water to build up on the balcony and that's the reason for the leak/water penetration. A job well done, or so I thought.
During spring 2021, the leak persisted. I contacted citizen again and recieved no reply. During summer, we had very little rain and so I thought maybe the situation had been resolved and I had not been informed. However, we are now in Autumn 2021 and the leak is back with a vengeance. It's that bad at the moment, the plasterwork is begging to fail and fall away from the affected area.
About two weeks ago, I emailed Citizen again informing them that the problem persists and that it needs to be resolved.
Naturally, I've had no reply.
The only thing I care about is stopping the leak as it is damaging my property.
With that in mind, what actions can I take to recover costs/resolve the situation? I have an idea, but was hoping others who may have been in a similar situation could assist.
QUICK NOTE: Due to the layout of the block of maisonettes, I am unable to access or contact the dwelling above. Basically, my dwelling has its own entrance. The rest of the building has a communal entrance which is restricted to individuals with fobs.

Is a Landlord required to consider/act on the advice of a medical professional in providing suitable alternative accommodation for a leaseholder if pending major work is likely to be detrimental to their health as a result of noise generated by the work?

At the beginning of the summer, I signed a sublease/roommate agreement for a room in an apartment, on a month to month basis, with 60 days notice required to terminate. There were a lot of issues with the roommate, so at the beginning of October, I found a new place to live starting November 1st. I informed my roommate of my plans, gave my notice, and suggested that I find a replacement tenant for November 1st. He said βno, Iβd rather find a new tenant myselfβ. I thought this was reasonable, but he just announced that he will be having a new person move in on December 1st - meaning that I will be losing my last monthβs rent deposit. I know that 10+ people responded to his ad online who could move in November 1st, so Iβm honestly baffled that heβs chosen someone for December instead. Is there anything I can do at this point? Or do I just have to say goodbye to my last monthβs rent?
