Repatriation of Cultural Objects Bill


A

BILL

TO

confer new powers to allow certain entities to repatriate all types of cultural objects and to better facilitate the return of other materials already permitted.

BE IT ENACTED by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Lords, and Commons, in this present Parliament assembled, and by the authority of the same, as follows—

Section 1 - Entities to which this Act applies

(1) The provisions of this Act apply to entities listed in Schedule 1, Schedule 2, and Schedule 3.

(2) The Secretary of State may, by order, modify Schedule 1.

(3) The Secretary of State may, by order, modify Schedule 2 with the consent of the Scottish Ministers.

(4) The Secretary of State may, by order, modify Schedule 3 with the consent of the Welsh Ministers.

Section 2 - Cultural Claims and Repatriation Board established

(1) There is hereby established a Cultural Claims and Repatriation Board, referred to as “the Board” in this Act.

(2) The Board members are to be independent in the exercise of their functions.

(3) The Secretary of State may appoint Board members, of which there should be no more than 7 and no fewer than 5.

(4) The Board members are to be remunerated for any services conferred.

Section 3 - Power to repatriate objects

(1) Any entity to which this Act applies must transfer from their collection any object if the following conditions are fulfilled:

(a) a claimant has submitted an application to the Board for the repatriation of an object on behalf of another person, a community of people, or themselves;

(b) the Board has considered the following factors when examining the application—

(i) the legality of the possession of the object;

(ii) whether the object is human tissue in whole or in part;

(iii) the legitimacy and veracity of the claimant’s application;

(iv) the ethical circumstances which led to the possession of an object;

(v) the impact on relevant communities caused by the present possession of an object;

(vi) the proposed use and conditions of an object after any repatriation;

(vii) the safety and security of an object, including from it's claimant;

(viii) the United Kingdom’s international obligations;

(ix) the connection the claimant, or a person they have submitted the application on behalf of, has with the object.

[EVENT] American Cultural Repatriation Act

President Clinton today signed into law the "American Cultural Repatriation Act", an act which will see the United States return a great quantity of artefacts taken from Native American populations to their respective tribes.

Although NAGPRA sought to restore artefacts to Native Americans, the act was limited - it required tribes to act first and only applied to federal collections. The ACRA will apply to federal, state and large private collections, and the onus is on federal and state governments to actively repatriate the artefacts (tribes though must make first contact regarding private collections).

While ACRA has drawn criticism, with some claiming there is no right to repatriate artefacts from private collections, Native American advocacy groups have fiercely defended the move, calling it one of many measures needed to be taken by the United States.

Some in archaeology however have criticised the act - often, tribes are more exploitative of the artefacts than the federal government. When owned by the Smithsonian, artefacts are kept in good condition and studied, and shown for cheap to a worldwide audience. In tribal hands, the artefacts are often shown at extortionate prices or to a limited audience. While the federal government has taken action to help the Smithsonian reach out to the tribes, many claim it's not enough.

ACRA will see remains and artefacts transported across both national and state lines, and have objects be returned to many tribes in both the UPA and CSA. However, the PSA has been removed from this policy - which also has drawn criticism, with reservations in Montana and North Dakota not seeing their rightful artefacts returned.

Separately from ACRA, the Smithsonian will also be returning a large number of artefacts to international museums - African, Greek, Egyptian, Chinese and Polynesian authorities being the best set to benefit from these returns. In lieu of returning items to the PSA, which has been barred from the move, many Hawaiian and Polynesian artefacts will be given to trusts in New Zealand, the country with the best existing infrastructure for Polynesian cultural heritage.

ACRA is the first step among many which we must take to help reconstruct Native American culture after centuries of war waged against it by America. The least we can do to apologise is return stolen goods.

How long did the Romulan government know about the pending supernova?

To my recollection, Star Trek: Picard is noticeably mum on the cause of the Romulan Supernova, likely in order to leave open future story possibilities. Some, including the writers of Star Trek: Online, have suggested that the supernova may not have been naturally occurring. (STO suggests it was the Iconians, if memory serves.) For its part, Picard (and to a less extent 2009’s Star Trek) vaguely imply that it was a natural catastrophe.

We know that Captain Picard left the Enterprise and was promoted to admiral expressly in order to deal with the pending Romulan Supernova. Background materials date his departure to 2381, although the show itself does not specify, and the tie-in novel The Last Best Hope actually does a couple of small acrobatics to likewise avoid specifying a date for his departure (which suggests an editorial directive to leave that part of the story vague and open for future stories), although it is clear that it is sometime in the early 2380s.

We may assume that the Federation learned of the Romulan Supernova shortly before they promoted Picard. The Last Best Hope makes clear that Romulan officials knew about the Supernova by that time as well, although the on-screen material is a bit less precise on this point.

In short, we actually have very little evidence to draw on to answer my title question. But I think it’s worth further consideration, and an examination of the possibilities.

One conceit I will draw on here – I will consistently assume that “the Romulan government” refers to the individuals and groups in the Romulan power structure who were both senior enough to know top-secret information and influential enough to direct Romulan political and cultural forces alike. It is of course possible that the supernova was known by marginal scientists (for example) long before word made its way up to the Praetor. But for simplicity’s sake, I will operate under the simplifying conceit.

So: how long did the Romulan government know about the pending supernova?

#A) Only once the Federation told them.

Under this interpretation, we have a pretty damning indictment of the Romulan scientific community – an ultimate case of Romulan society reaping what it sows, perhaps prioritizing the military above all else. Picard also deepened the depiction of Romulans as deeply secretive and suspicious. Recently repatriated and struggling

Hello everyone, hoping you're all having a good one.

I'm Kuwaiti, I left for college at an early age, and enjoyed life outside for almost 6 years. After having to return, and having been forced to raise myself in those crucial late teen/early 20 years, I'm finding it so hard to adjust, especially that I got so used to the freedom and independence I had for over half a decade.

From being in a tight, close inner circle that was so respectful and accepting of my choices (none sinful religiously), I find myself going from independent and in control, to dependent and controlled. From a small, but respectful inner circle (all that I needed socially), to having to bend over backwards to please others and social norms that I could really do without them being shoved down my throat. You constantly hear stuff you don't want and you can't do anything because you gotta respect and please others, especially elders and family.

In short, this repatriation has been extremely difficult and has left me beyond depressed. I'm asking anyone who has experience with this (or even those with mental health and/or psychological experiences) to please help me with advice, discussions, or suggestions.

Please be respectful, I'll be nothing but respectful myself. Also please don't feel attacked if you really love the cultural and social norms here, it's mostly people (non-religious) stuff, and people have the power to choose and be happy, and I don't intend any attack on anyone. Just want more air to breathe I guess. Also, in case people start mentioning the blessings of the place, I don't deny them, but when you see negatives more prominently, it's so damned hard to realize the blessings and positives.

Any help or talk constructively is beneficial, please don't spare a genuine thought. Apologies for the long post, couldn't keep it concise like I wanted.

High school teacher in China, reading your tales of woe

Been doing it for a bit over a decade now. I teach a science course in a Cambridge IGCSE/A-level affiliated program in an eastern Chinese city. It's not an international school per se, 100% of the students are local, getting ready to go to college abroad. Such programs have been mushrooming in wealthy regions of China for a while now (the Nanjing-Shanghai Yangtze delta, Beijing, Guangzhou, Shenzhen).

I guess I'm making a bit less than what I would in a western country. In my company, depending on qualif/experience/seniority, teachers earn between 350k and 450k RMB, if I include end-of-contract bonus and flight allowance (I'm getting 12k twice a year, which I used for travel in the past, but now just feels like a bonus, since covid hit). That corresponds to 55k-71k USD. We get taxed, but the taxation level is not that high, I think it's 20% of any monthly earnings past 5k. Higher, or even much higher salaries and expat packages, are not unheard of.

I get a housing allowance which pays 90% of my lodging. I have a sweet two-bedroom pad 5 minutes from my school and 10-15 minutes from the city center (note that I'm in a smaller city, people living in Shanghai or large provincial capitals might have a bit of commuting to do, or choose to do so). Utilities are fairly cheap.

The cost of life is quite low, and even though I don't live particularly frugally, I save most of my paycheck.

And regarding the teaching itself, it's not perfect (more on that later) but overall it's pretty pleasant. Also, please note that YMMV (your mileage may vary) tremendously, depending on the school you end up in, its principal, its admin, and the cohorts of students admitted. I worked at shitty schools that eroded my mental health, but now I consider myself fortunate to be in a good spot. Notably, the discipline problems are quite insignificant, and might as well be considered non-existent by my coworkers who've taught in the American or British or Canadian system (and not in ghetto-ass gang member schools, or in like West Virginia, mind you; just normal run-of-the-mill underfunded schools where nobody gives a shit about anything)

I myself haven't taught in my native Canada. I came to China after finishing college, and after a short stint in ESL mills, I became a science teacher even though I didn't have a BEd, only a bachelor's in science. I eventually did a PGCE, and my company paid for it.

A Monyet Condenses: The Rise of Conservative Islam in Malaysia

TLDR: Conservative Islam (Salafi-Wahabism) in Malaysia is a direct influence of Middle Eastern geopolitics, intermixed with Malaysian race based politics and fueled by the oil boom of the 1970s that persists to this day. Malaysians gloss over this because of its complexity, but it also leaves many frustrated, because of a lack of understanding as to the how/why/what's of Wahabism. Most disappointingly, what I found lends credence to the idea that Najib really could have received money from Saudi as a donation for the promotion of their conservative Islam.

Foreword

Assalamualaikum Warahmatullahi Wabarakatuh dan Salam Satu Malaysia kawan-kawan.

Originally I did research into Islam as part of research into a story concept I was developing, but with all the news about religion, 4D and logistics mandates, I figured I would share an overview into the factors that have and will continue to influence Wahabism in Malaysian society today. It is an attempt to demystify the complexities of Middle East, and to show the significance of history in understanding the causes and effects of Islamic Revitalization that began in the 70's. Because of the vastness of the topic, I will be only highlighting specific people and nations.

Just know, if you've ever heard people say "agenda yahudi" or "pengaruh barat", they are usually (at least I hope so) referencing the very real historical manipulations by the West, which in turn became one of the driving forces for this Islamic revival, which in turn created more anti-Jew conspiracy. How fun.

The funny thing is, we already have all the information we need. All the names and dates are all online, but what you really want, what you really need is a story. Stories can be true or false, but I leave such judgments to you monyets.

Throughout the negotiation process, NK has never been viewed as a territory where only Armenians would live. The issue of the Azeri population has been part of the negotiations.

The referendum was never going to be held according to our liking, but even if it were, NK's Azeri population would also take part. Now the question is, would the Azeris of NK, in their turn, be allowed to [break away from NK via a similar process]. What would happen if that question was raised? These are not abstract questions. It's based on the nuances of what was on the negotiation table, which has never been discussed in public.

Today we hear voices, thoughts, and cherrypicked sentences that, in fact, have nothing to do with the package of negotiations that we had as of 2018.

 

3 packages were offered in 2016, and for the first time since 2011, NK's interim status was not part of it. Sure, NK would have a legislature, judiciary, etc. But no one is mentioning that the issue of clarifying NK's interim status, according to that negotiation logic, was transferred to the UN Security Council. What is the problem with that?

Throughout the entire negotiation process, Armenia attempted to keep the final resolution within the OSCE Minsk Group framework. In 2016 the parameters to solve the issue were transferred to the UN Security Council.

Pay attention to Levon Ter-Petrosyan's 2017 interview to H1. He mentions that the international community will decide NK's status.

[What decision would the UN Security Council make?] The question is, part of which country will NK remain before its final status is resolved? When it's the UN Security Council handling it, the outcome is very predictable, because in 1993 they adopted a resolution stating that NK is part of Azerbaijan and that they recognize Azerbaijan's territorial integrity.

This is the 2016 disaster. Under this logic, NK's final resolution must be handled per the Azerbaijani constitution.

##government wants to find alternatives to Georgia's problematic Upper Lars cargo route

It's the only land route Armenia currently has to its main trade partner Russia. It's closed "half of the year" because of bad weather, bad traffic, or bad politics between Georgia and Russia. Armenian exporters face the consequences.

Economy Ministry: we drafted a bill that offers to reimburse Armenian companies if they use the Poti-Caucasus Port-Poti ferry.

The proposal is necessary because our only land route to Russia is routinely closed, causing problems for Armenian cargo. Since ferry is more expensive than land, and can reduce Armenian product's competitiveness in foreign markets, we are willing to compensate.

Our trade is growing with EAEU member states, yet Upper Lars remains our only land connection to them.

Upper Lars can only handle 170 cargo and 200 passenger vehicles per day in two directions. The traffic exceeds this capacity by orders of magnitude during certain periods. Armenian vehicles cross it 10,000 times a year.

The approval of the bill will help Armenian cargo companies during the seasonal high-fee periods. This can greatly increase cargo exports and make Armenian products more competitive. //

The subsidy for one-way ferry transfer is ֏0.5M, or ֏1M for two-way.

Pashinyan: I believe the launch of the Gulf-Sea international route can boost regional cooperation.

Bilateral cooperation in the field of transport is a priority for us. We view relations with Georgia not only in the sphere of bilateral but also in the sphere of regional cooperation. We can help each other.

We have two Gulf-Sea route projects: vehicle and railway.

Vehicle: we are developing the North-South highway network in Armenia. It connects the Georgian border to the Iran border. We're working with Georgian and Iranian colleagues to make the road more efficient. If we are also able to come to an agreement with Azerbaijan, this project could expand and become North-South and East-West.

The Sochi and Brussels meetings created the opportunity to possibly come to an agreement with Azerbaijan over restoring vehicle routes. As for railway connection, we already have an agreement with Aliyev over principles. It's abo

(a) a claimant has submitted an application to the Board for the repatriation of an object on behalf of another person, a community of people, or themselves;

(b) the Board has considered the following factors when examining the application—

(i) the legality of the possession of the object;

(ii) whether the object is human tissue in whole or in part;

(iii) the legitimacy and veracity of the claimant’s application;

(iv) the ethical circumstances which led to the possession of an object;

(v) the impact on relevant communities caused by the present possession of an object;

(vi) the proposed use and conditions of an object after any repatriation;
