Would it be legal for a state government to ban particular foreign nationals from attending school in state universities?

I remember UMass Amherst had a brouhaha a while back because they banned Mechanical Engineers from Iran in enrolling (though they retracted because they said they misinterpreted a federal regulation)

Let's say the Massachusetts legislature passes a law saying "no higher education institution in this state can enroll Iranian nationals". Would such a law be able to stand 14th amendment, immigration and civil rights pre-emption?

Assume it's an Iranian national lawfully living in the Massachusetts that is now applying to UMass Amherst so no standing issues

INTERESTING. In a letter to the SEC in 2004, Citadelโ€™s Chief Legal Officer complains how the options market is rigged and why payment for order flow creates serious conflicts of interest and should be banned. Funny how their opinion has changed in the last 18 years, after becoming the largest MM.

Re: Release No. 34-49175; File No. S7-07-04 โ€” Competitive Developments in the Options Markets

Dear Mr. Katz:

Citadel Investment Group, L.L.C. (โ€œCitadel Groupโ€) welcomes this opportunity to comment on Commission Release No. 34-49175 (the โ€œReleaseโ€). The Release discusses recent changes in the listed options markets and seeks public comment on whether the Commission should take action to improve efficiency and competition in these markets.

Volume has increased in listed options markets in recent years due to improvements in liquidity, transparency, and competition in these markets. The ability of investors to efficiently use the listed options markets is an important cornerstone of our national market system. It is thus crucial that the Commission implement reforms that will further this trend. Specifically:

โ€ข The firm quote rule would best serve liquidity and transparency if it applied to all listed option order types up to the displayed size of any quote.

โ€ข The practice of payment for order flow creates serious conflicts of interest and should be banned.

โ€ข Internalization without meaningful price improvement reduces competition, limits price discovery, leads to market fragmentation, and should be banned.

โ€ข The Commission should not yet require the listed options markets to quote in decimals because decimalization would overload systems already pushed to their limits and lead to less transparent and shallow markets.

Citadel Group welcomes the issuance of the Release and the Commissionโ€™s other efforts to consider and open for discussion fundamental issues relating to market structure and regulation. The Commissionโ€™s willingness to focus on these difficult issues and ask the hard questions works to ensure that the U.S. markets remain the strongest and most efficient in the world.

Your Opinion: Using foreign cultures as inspiration in fantasy?

I am European and i think it is ok for me to use european cultures in a fantasy setting or basing fictional civilizations or ethnic groups off actual european people of the past. Literally all of these ancient cultures ceased to exist and transformed into the modern nation states we have right now.

But what about cultures based on tribal societies that still exist ? Like the Native Americans, the Aboriginies, Tribes of Asia or Africa. Is it really right to use them or have cultures be based onto them in fictional story that, if one is doing it properly, can generate an income? Ofcourse i do not mean to copy foreign cultures, but lets assume you have an vast continent akin to the Americas, people that live there would be mostly nomadic, have certain phenotypical features, various tribal groups and the useage of specific patterns or feathers used in their dressing, it will be obvious these people are based on native americans. Lets call the continent Ayami or Amayali, havent decided which name i prefer more. Ayami sounds smoother, but Amayali has a more "native american" vibe to it, to me atleast also it should be an reference it its real world inspiration which is the Americas.

A MAJOR difference however is that these people in that setting became farmers and animal herders in curse of their history (on their own not due to colonialism) they domesticated bisons, they domesticated horses, pigs and in the southern, tropical areas even certain dinosaur like creatures. They ended up creating several tribal kingdoms, some more powerful, some less. But there are no real hunter gatherer socities left, maybe in some remote jungle regions, but even there they would most likely have switched to agriculture and raising animals like tinamous, peccaries or cabybaras. In the southeast coast, an tropical area reminiscent of brazil, a large tropical areas with a massive river system, a society formed that should unite elements from the Minoans aswell as the Mayans form our real world.

So these people are not actual native americans, the world it plays in is not our world just with a different outcome or a different history. It is a high fantasy world.

Native Americans seem to be incredibly sensitive about this subject, which i can fully understand, so my question is, is it really a good idea to base a culture onto them? Or should i cut it or atleast make up an own culture, but where does the appropriation begin? Is them simply using featers or headdresses already

Partner of new Supreme Court Judge is a Swiss national employed in Swiss Federal Dept of Foreign Affairs (Swiss Embassy) as "Human Rights Activist" This news comes as Supreme Court is at loggerheads with govt to allow unbridled foreign funding for political/legal/social/religious activism in India.

https://www.msn.com/en-in/news/other/meet-saurabh-kirpal-likely-to-become-india-s-first-gay-judge/ar-AAQKGo6

Nicolas' LinkedIn Profile l writes "Swiss Government Employee" from 2016 onwards- in "Swiss Federal Department of Foreign Affairs" under "Humanitarian Affairs" in New Delhi.

Coincidentally the first time SC collegium approved to make Kirpal SC judge was just months after Nicolas Germain Bachmann got position in Swiss Foreign Embassy in New Delhi. Prior to that- from 1995-2015, he was working in International Red Cross in different positions.

Meanwhile media like TOI, Wire obviously are making govt's reluctance to appoint Kirpal about his sexual orientation and not about the gigantic conflict of interest the size of Indian money in Swiss foreign accounts that Kirpal would literally be empowered to decide all governance of India, while being family member of Swiss govt employee.

Earlier in 2020, when GOI had banned protests to be funded by foreign funds, SC had repealed the GOI order. Currently it is hearing plea to make FCRA laws more lenient which requires all those organisations directly or indirectly receiving foreign funds to be registered with GOI to track the funding.

Your welcome to your opinion, but here is a lawyers opinion. Maybe your not-concerned about breaking a contract with someone with far more resources then you, along with not being concerned about applying for the EV tax credit, which says "not to be used for resale". You can argue in court and with the IRS all you want, you may even win, but it wont cost you nothing to do it.

For the unaware: The people of Barbados had no say whether they wanted to be a republic. The prime minister refused a referendum on monarchy. She also lied to foreign media that it was in her party's manifesto. The last opinion poll on the issue had 64% support for keeping Queen.

Last year Barbados Prime Minister Mia Mottley announced Elizabeth II was to be removed as Queen of Barbados on 30 November 2021. Instead the head of state would be a President appointed by parliament. This was just as much a surprise to Barbadians as it was to the rest of the world.

There were no hints in the run up to the announcement this was in the works. However as the governing Labour Party held 70% of seats in the Senate and all-but-one seat of the Assembly there was zero chance of it being stopped. Amending the Barbadian Constitution requires only a two-thirds vote in both houses. Unlike most Caribbean countries, constitutional amendments aren't required to be approved by a public vote.

When questioned by ABC Australia why the government wasn't holding a referendum on this issue PM Mottley claimed it wasn't necessary because it was in her party's manifesto. This was a bare-faced lie.

The BLP's 2018 manifesto made zero mention of becoming a republic, let alone doing so without a public vote. You can read here yourself. Previous manifestos had mentioned holding an inquiry into becoming a republic but this was always stated on condition of approval by the people.

In fact their 2018 manifesto actually promised to use referendums to allow Barbadians to have more direct input on 'major national issues'. There is one being planned on the legalisation of marijuana. Regardless of your opinion on that we can all agree removing the nation's monarch is at least as important of a constitutional issue as weed.

As a column in Barbados Today said.

>If fundamentally changing our system of Government to a Republic, does not qualify as a fundamental issue affecting the stability and cohesion of our nation, then what does?

https://barbadostoday.bb/2020/09/19/btcolumn-no-referendum-no-republic/ (Archive)

Why was Mottley so curiously reluctant to hold a vote on this? I mean she said there's a consensus and "Barbadians want a Barbadian head of state", so what's wrong with just asking them?

Well some of her fellow republicans are a bit more honest. They admitted if a vote was held there's a good possibility it would be rejected. Barbadian political scientist and republica

[Discussion] Are in-game virtual items that can be sold for "real money" considered securities under US Law? (e.g. Roblox) (not legal opinion)

EDIT: My argument is very flawed, check the bottom of this post.

I came across this thread on Reddit about Roblox and various practices they employ, whilst there was a lot of concerning things, I have some questions about the in game items and marketplace offered by Roblox.

One of the comments I saw was about Roblox's valuation on the stock market and that got me thinking about what I consider a securities market within Roblox itself.

I would like to hear your thoughts on this and whether or not you'd think these items to be considered securities. I may have gotten certain things horribly wrong with regards to US law, assumptions made etc, so feel free to call me an idiot if so, but please point out your counterarguments! My post mainly focuses on Roblox, but realistically it could be applied to any game that allows in game items to be resold.

https://np.reddit.com/r/videos/comments/rfgazz/roblox_pressured_us_to_delete_our_video_so_we_dug/

I know they're only in game items, but I think they could be classified as securities because they can be bought and sold (indirectly) with real money (via robux).

Now of course I am not a lawyer, and have no clue how any of this works (and how it probably also doesn't apply to many other companies that sell, resellable in-game items)

##The Howey Test

> The Howey Test refers to the U.S. Supreme Court case for determining whether a transaction qualifies as an "investment contract," and therefore would be considered a security and subject to disclosure and registration requirements under the Securities Act of 1933 and the Securities Exchange Act of 1934. Under the Howey Test, an investment contract exists if there is an "investment of money in a common enterprise with a reasonable expectation of profits to be derived from the efforts of others."

###Investment of money

> โ€œThe first component of the Howey test focuses on the investment of money. The determining factor is whether an investor chose to give up a specific consideration in return for a separable financial interest with the characteristics of a security"

  • Securities & Exchange Commission v. SG Ltd., 265 F.3d 42 (1st Cir. 2001)

When Roblox releases an item for sale, I believe that it could constitute an investment of money, as the purchaser gives up their Robux (specific consideration) in return for an in-game item (separable financial interest with the characteristics of

This question seems to be splitting opinions in my social circle. Is it legal to drive a car down to a webuyanycar centre when the MOT has run out?

It won't pass the MOT and we've decided to go down to a one car house for a while.

I queried with webuyanycar if they would pick it up and came back with

" Hi,

Not a problem, we do still buy cars with no MOT and you are allowed to drive a vehicle with no MOT if you are going to a garage to sell the car or have it serviced however if you wanted to play it safe there is always a recovery vehicle option.

I understand if you do not wish to pursue that option but we look forward to hearing back from you should you wish to go ahead."

In my opinion, it's pretty stupid for (the official administration) universities to have a stance on foreign affairs, and in fact, no citizen should oblige public government bodies to have a stance

When you are a citizen of Canada, your stances should be about Canadian politics. You can have your opinion on foreign affairs, but to pressure governments or publicly funded bodies to talk about foreign affairs that might go contrary to our allies is insane.

Canada is allied with Israel. I don't like what Israel does in the Palestine conflict, but I also don't like the Palestinian side. Regardless of which side, to call on a publicly funded school to side with one group but not another is insane.

I bring these two up because they are major schools, however, my small school would not run an event featuring Jewish students talking about their views on the conflict but allowed the Pro Palestine talks (I know because I had a friend in the school's government body)

https://www.ubyssey.ca/opinion/palestine-and-ubc/

https://www.thestar.com/news/gta/2021/11/30/u-of-t-calls-pro-palestinian-motions-passed-by-scarborough-student-union-unacceptable.html

Point being, saying you are siding with the Palestinian Canadians and we are here for them etc but not with the Israelite Canadians is racist.

Further more, stuff like the China vs Hong Kong issue why back, I support Hong Kong's right for more freedom (fuck Chinese authoritarian governments honestly), however, I think it's stupid that both sides are not loyal. The unpopular opinion is, we are all canadians. I don't care if you are hong kong or chinese, but if YOU bring it up, and say that the Canadian government must side with you, fuck it. The Canadian government can side with any country, but not play favoritism to it's citizens WITHIN the borders. Canada shouldn't only listen to hong kong -canadains or only chinese-canadians. (Fuck Canadian government though, they do play favorites to the Chinese-Canadians )

What are your opinions and/or rebuttals in regards to some of the arguments in regards to why abortion should be legal?
  1. A woman has a right to control her own body and its life-support functions.
  2. The right to abortion can be construed to be necessary in order for women to achieve equality with men whose freedom is not nearly so restricted by having children.
  3. The criminalization of abortion furthers the marginalization of oppressed groups such as poor women and women of color.
  4. Making abortions illegal will simply cause women to seek out different, less safe abortion options.
  5. Probably one of the most controversial opinions is the relation between Legalized abortion and crime, in that legalized abortion has helped to reduce the crime rate.
