Potential Updates to SAFE Act and Truth in Lending Act

For those of you who are interested in the lending side of real estate.

Efforts are being made to amend Dodd-Frank in order to enhance Seller Financing. The goal is to introduce a bill this month, October 2019. With the House being controlled by the Democrats and the Senate by the Republicans this would be a bipartisan effort in order for the changes to be signed into law.

The purpose of the Seller Finance Enhancement Act is a small adjustment to both SAFE and TILA. Specifically to change the current limit of three (3) Seller-Financed transactions an individual may engage in during a 12-month period without being licensed and increase that number to twenty-four (24).

There is no attempt being made to modify any of the consumer protections within SAFE, TILA or Dodd-Frank. The goal is to raise the yearly transaction limit.
