Thao is asking for his charges to be dismissed, alleging that Dr. Baker's conclusion that neck compression played a role in Floyd's death was coerced, that the prosecution was aware of this, and should not have let Dr. Baker testify.
The claim is that Dr. Roger Mitchell, former ME for Washington, DC had access to the early findings and had 2 conversations with Baker before he released his autopsy that allegedly included:
- Baker saying he didn't believe neck compression played a role
- Mitchell threatening to publish an op-ed in the WaPo critical of his findings
- Mitchell saying that neck compression had to be in the diagnosis
It also includes the following quote:
"[Mitchell said] you donโt want to be the medical examiner who tells everyone they didnโt see what they saw. You donโt want to be the smartest person in the room and be wrong. Said there was a way to articulate the cause and manner of death that ensures you are telling the truth about what you are observing and via all of the investigation. Mitchell said neck compression has to be in the diagnosis.โ
I don't see the exhibit being quoted from so context is unclear but maybe this is from prosecution notes from meeting with Mitchell? It's not clear how Mitchell got involved prior to the release of the autopsy (e.g. was he consulted for a second opinion) or if this is all that he allegedly said.

EDIT: Thao is also claiming coercion of Dr Fowler, since Mitchell is the one who spearheaded the letter that led Maryland to open an investigation into the police custody deaths during Fowler's tenure.
Most specifically the 2016 album "A Man Alive." Haven't listened to this one since its release, and only then just a few tracks.
Today I gave it a full sit down on a small day trip to the next state over. Listened to it straight through three times in a row. I am amazed & now obsessed.
I can't remember what tracks I listened to five years ago, probably the most "radio friendly" songs as I worked at the college station then. But for whatever reason, they did not make the impact on me the way today's listening did today. In fact, if I remember correctly, I may have thought her sound was too weird.
And it is weird. But just the right amount. Measured & expertly executed. Creative use of distortion, synth & xylophone. Fantastic lyricism & delivery from Thao. My hyper obsession with this album may also come from the fact that it describes my most recent break up in uncomfortably accurate detail.
But the bass. Oh my god the bass performance by Adam Thompson. My jaw quite literally dropped multiple times through listening to these ambitious runs.
This record has left me awestruck. Always grateful to be reminded of the sheer power of a truly perfect album.
Was just listening to her 2020 drop, " Temple" the other day too. It wasn't for me at the moment. Again, a bit too weird. But maybe I will grow into that one as well.
My understanding is that they are also witnesses for these defendants
Lots still going on in Chauvin's case with Nelson filing preliminary motions, and the issues relevant to Chauvin (e.g. witness intimidation, change of venue, jury sequestration) will likely be brought as issues by the other officer's lawyers prior to their trial scheduled for August 2021.
