Sorry if this is not an appropriate sub for this, but r/legaladviceuk didn't really seem suitable. I come as an emissary from r/juniordoctorsuk where, along with generally moaning about the NHS, there's been a fair amount of concern about this case recently. I wondered if any of you bright legal minds have any thoughts?
My understanding of the case is that a lady came to the GP (defendant) for pre-conception advice and they discussed folic acid supplements, the facts of the specific advice given is contested. The lady then conceived almost immediately and gave birth to the claimant who had spina bifida. The type of spina bifida is not caused by folate deficiency. The claimant alleges that if different advice had been given then her parents would have delayed conception and therefore a different person who would likely not have a disability would have been born and therefore the defendant's negligence in not advising delaying conception until after folate had been started has caused her to have this disability.
Reading through the judge's summary of the case online it seems the only issue that's made it to court is the facts of the specific advice offered to Mrs Toombes about pre-conception folate. Honestly if I was having to defend a claim against me for negligence where I had caused harm and needed to rely on a similarly brief note in the medical record I'd be getting out my cheque book, but the issue a lot of doctors are struggling with is the idea that this act caused harm in the first place. The idea that the February conception random number generator rolled 'spina bifida', the April one might have rolled 'healthy baby' even though the probability remains the same and that the advice given to start trying is therefore to blame seems wild.
Is this an accepted legal principle? Do you guys have any thoughts on that or explanations that might make some sense of it all? I'm not looking for legal advice for myself, I'm sure we'll all be getting updates from our defence unions soon and in any case as a paediatrician my pre-conception advice tends to be "don't". Just interested.

November 29 - Evidentiary Hearing
Brief synopsis: Evidentiary hearing was held to determine whether evidence of the prior acts of molestation were admissible. Bobye Holt, a family friend, testified that Pest had confessed to her when he was younger and that the molestation took place over the course of years. Jim Bob Duggar testified and claimed to not remember much about the molestation but that it wasnβt a huge deal. The Defense claims that the information Pest confessed to Holt should be excluded under the clergy-penitent privilege rule.

Iβm terrified because itβs becoming more clear that my rights as a woman arenβt respected or valued. Now weβre looking at possibly moving that up or changing our plans.
I donβt feel safe here. I live with PTSD from being sexually assaulted causing bodily harm. I couldnβt imagine if something like that ever happened again and I ended up pregnant. I struggle with bodily autonomy as it is after that. I donβt need anyone else telling me what I can and canβt do with my uterus.
I moved to the US from Canada after that assault 3 years ago. It was for a fresh start and I met my husband.
