The following are the early termination clauses in my contract which left a bad taste in my mouth but I felt I was out of options at the time.
I'm considering leaving early but, this being a 2 year contract, I'm looking at about 20 months of these fees and fully expect them to take 2 months to re-let at around Β£300-400 less than what I'm paying.
What I'm after is two things:
- do these terms seem legally enforceable, particularly the one about covering the difference in rent and paying the agent's commission (seeing as they'd be getting double-paid for it)
- if it seems like I might have a chance of challenging this, can someone suggest a good property law firm and/or ways of finding a good one?
Early Termination
- If the Tenant vacates the Property prior to the end of the fixed term (or break clause if applicable), the tenant will remain liable to pay rent until the Fixed Term expires or the Property is re-let whichever is earlier.
- And if the new Tenancy is for a lesser Rent, the Tenant will remain liable to pay an amount equal to the difference between the original rent and new lower rental figure up to the end of the original Fixed Term.
- Should the property be re-let during the Fixed Term, the tenant will also be responsible for the repayment of any pro-rata commission fees that have been or will be incurred by the Landlord for the unexpired portion of the Tenancy at ${AGENTS} Rent Collection fee of 12.48% inc VAT (10.4+VAT), or of the rent for the Fixed Term of the Tenancy.
- The Tenant will be responsible for the associated reasonable costs incurred by the Landlord to arrange a new Tenancy. These cost include the deposit registration fee Β£120 inc VAT, the tenancy set up fee Β£360 inc VAT, new tenant referencing cost Β£60 inc VAT per person, the check in cost (Β£138-Β£180 depending on bedrooms), the check out cost (Β£138-Β£180 depending on bedrooms) and the deed of surrender Β£50 inc VAT.
