Indefinite Leave to Remain (ILR) Query - Maintaining ILR by only visiting the UK every 2 years as a minimum

Hi everyone,

I will be eligible for obtaining an ILR by 2023 after being sponsored by my company on a Tier 2 (now Skilled Worker) Visa since 2018. I am originally from Malaysia and may have plans to go back there after obtaining my ILR to potentially get married and take care of my parents for an extended period. I may even have to apply for a new job in Malaysia if my time away from the UK would be more than 6 months.

If my understanding is correct, would I be able to maintain my ILR if I JUST visit the UK for a couple of weeks every 2 years (even if I don't have a job in the UK)?

I would appreciate any feedback from people who have gone through the same situation or is intending to.

How losing a visa and coming back affects indefinite leave to remain?

I've been in London on Tier 2 visa for 2.5 years, lost my job and looking for a new one now. What if I don't have enough time to find a new job and have to move out of UK temporarily (say 2 months) before coming back, will I still have those 2.5 years count toward indefinite leave to remain or will it be a reset to zero?

Looking to change my name and gender as a foreign national but I hold indefinite leave to remain

Hello,

Hold with me here this is slightly complicated but i'll do my best. I understand this is a very specific question and that most people here probably have no idea.

I'm a Greek national who's residing in the UK and have done for the last year. I hold indefinite leave to remain.

I'm transgender and looking to change my name and gender (Male to Female) My complications arise because the Greek government won't assist me in such and therefore my Greek passport, the only passport I currently hold, has to remain with my original name and gender.

Therefore my questions are:

Can I change my name and gender with the home office without changing them on my passport?Could this affect my ability to enter the country or my right to remain?

Could I change my name and gender on all other legal basis such as the DVLA, HMRC etc. But not change them with the home office? Or would this cause endless legal complication.

I hope I worded this in an understandable way and any help would be much appreciated. Thank you.

Indefinite leave to remain (10 years/ long residence) documents to provide

Hi,

I am planning to apply for ILR (long residence route) and had some questions about documents that need to provided.

I am originally from S.Korea and have been in the UK for 10 years as of this week. I haven’t left for more than 180 days at a time / haven’t left for more than 540 in total. I did hold a tourist visa (one that you get as a stamp when you enter the country) but my understanding is that it should count as legal stay.

History of my visa -

  • Tier 4 Student visa for (Foundation yr)
  • Tier 4 Student visa for (Bachelors)
  • Tourist visa for 6 months
  • Tier 5 youth mobility scheme
  • Tier 4 Student visa (Masters)
  • Tier 2 (current visa)

I am digging around to find out what documents I need to provide to get the ILR and it seems like all I need to provide is life in the UK test, all passport held during 10 years / any english qualification.

This almost seems too easy compared to all the other visa applications I have done before, so I am wondering if I am missing anything. I did create an excel sheet to work out the exact dates of my leave but not sure if I will be able to recover all those flight tickets. Was there any other documents asked? e.g. proof of addresses, bank statements?

For those who paid for the priority service, what was the turn around time from application to receiving BRP?

Lastly is it recommended getting a solicitor when your history is relatively straightforward?

Indefinite Leave to Remain

I have a Settlement visa with Indefinite Leave to Enter. I’ve been living in the UK for two years now, going into three this October. I want to apply to uni this year for 2022 entry. I’ve been in touch with my uni choices regarding fees and some of them require me to have Indefinite Leave to Remain to be eligible for Home student fees. Otherwise, I’ll most likely pay International student fees. Can I apply to have ILTR? I’m at a loss on what to do.

European citizens with indefinite leave to remain in the UK - I need your help!

Hi everyone!

I have an Indefinite Leave to Remain (ILR) in the UK in a passport that has expired, but they have let me keep it since my ILR is in there. I also have a valid Bulgarian EU ID card. I would like to know if any of you have traveled to the UK with an ILR in an expired passport since Brexit. My worry is they might not let me back in since I do not have a biometric one.

Please note, I am not asking for links to government websites, I have read a lot of that already. I just want to know what your experience is, did you have issues with border control, etc. I am most likely being overly anxious about this, and I sort of feel silly, but I just need a bit of reassurance.

Indefinite Leave to Remain help.

I’m applying for indefinite leave to remain at the moment but one of the questions has me confused…

One question asking about motoring offences asks if I have received any β€œpenalty” for any motoring offences.

Last year I was involved in an accident and the police sent me a letter saying I had driven without due care and attention but offered me a safety and awareness course instead of points on my license and a fine, does this still count as a β€œpenalty” though? Or do I still have to select the option saying I have?

Naturalisation: Indefinite Leave to Remain BRP

Currently applying to naturalise and the BRP section of the application requires an expiry date of the BRP. I’m an ILR holder so technically it doesn’t expire. It’s an online application so I can’t move on unless it’s filled in. Anyone know what to write? Might as well ask here since the call centre’s closed.

Applied for Indefinite Leave to Remain in September, still no biometrics appointments! Help!

Hi!

As I said above I applied for ILTR on Sept 1st. I still haven't received an invite email to book an appointment or an invitation to use the app to confirm my previous biometrics. It's now January and my application is just sitting in limbo and I'm starting to become extremely anxious!

Is anyone else waiting as well? It's making me nervous that I've heard nothing. I've been checking the website multiple times a day for appointments too.

Edited I registered with Sopra Steria immediately after submitting, but then was told I couldn't book yet due to the backlog and I would be emailed when I could. Still no email.

Help! Partner has Indefinite Leave to Remain but in expired passport. Challenges with BRP application/consistency.

My SO (27yo F) is a US citizen who holds Indefinite Leave to Remain (ILR) and has done since entry to the UK 11 years ago. We only discovered that the status of her eligibility to work in the UK is questioned because of this situation where she has applied for a new job recently (passport with ILR vignette expired whilst with current employer).

She has made an application for BRP but is 1) struggling to be able to book an appointment to present documents/provide biometric information and 2) there appears to be inconsistency in the application for the BRP that she has to make. Her brother (also with ILR) made an application but was not asked to provide history of residency for each year that he resided in the UK but SO has and so is having to scrape together as many bills that she can as well as asking for letters from her GP and her school as she completed secondary and further education in the UK.

Would appreciate advice on how to book an appointment before the window she has been given to provide paper work closes and to understand why there is a difference in the information that is requested between my SO and her brother.

We have tried to call UKVcas but interminably long wait and no other way to contact them.

Please let me know if any further information is required and thank you for the help.

If you're on an FLR(M)... and intend to apply for settlement (indefinite leave to remain)

Really thankful to this sub for the information re: supporting documents and the process. Application sent off on Saturday and UKVCAS appointment today - Fingers crossed it'll be successful!

  • Pass your Life in the UK Test well early, like months early - This test does not expire so you can literally take it now. I left this so last minute but luckily there was an appointment, and I passed in first go. I paid Β£65 which is a bit more than the Β£50 standard fee. The issue is that if you fail this, you cannot resit until a few days have passed, and you cannot submit your application until you passed this. (There may be Covid-related allowances around this but I don't recommend adding complications.)
  • Same goes for English test (but they do expire) - If you need to prove your English abilities, you should do this test well in advance but not too early because most of them do expire. The rules do change so double check - I think it's 2 years at the moment for Trinity College, for example. Now there are situations where you can reuse tests but check every word in the rules! You don't want to be refused on account of an expired English certificate.
    (Fun fact - I did the Trinity College racket and even though I asked for a B1 during my 2018 FLR(M) application they made me sit for an A2 so I literally had to do a B1 test again for the 2020 SET(M) application. Another Β£150 down the drain.)
  • Get paper bank statements, paper TV license and keep all your letters & documents - Don't be tempted to throw things out. It's very hard to find documents from 2.5 years ago when you need them the most.
  • Keep your passports, even cancelled ones - This is probably not going to be an issue for most but seriously you need these to show your travel history. So do not throw them out.
  • Employment. If you can, stay in the same job for at least 6-7 months before you make your application - The simplest way is to have the same job, same level of pay for 6 months then you just need to show 6 months' payslips & bank statements. You know the drill. But if you've changed jobs/pay level that becomes complicated. Now with Covid this may not be in your control but if you're thinking about applying for new jobs, may want to check your timeline.
  • Request HR letter so that they date it within 28 days of your application - I literally drafted mine for my HR people to sign, that made it significantly fast.
  • Get a scanner - You'll have to scan a lo

What was your reason for your Indefinite leave to remain to be refused under the long residence?

I am working as a doctor in the UK and I am from Hong Kong. I am just wondering What was your reason for your Indefinite leave to remain to be refused under the 10 year long residence? I was reading the gov.uk 's website for long residence and I noticed that they have quite a lot of rules and examples, I am afraid some of the times in the past (like waiting for BRP to arrive whilst in the UK) would cause the break/interruption in the long residence rule. For example, my BRP lasted from 2015 September to 1st October 2020, I started the procedure of applying for a new BRP in July 2020 and now I still have not got my new BRP, I have done the UKVICS photo submission via the app. I briefly saw the mention of entry clearance for some people about overstaying and I am not sure whether this is really relevant to me? Please help

Old Expired Passport and Indefinite Leave to Remain Application

Good afternoon.

I just need a little bit of advice, I am going to be applying for an ILR next month and have been reading about various documents that will be required during the process. It seems like the Home Office will be asking for the passport that has the initial stamp of my arrival in the UK.

I have since lost that passport. It was expired and void when I lost it and I already had a new one with me at the time so I didn't think to report it. I have read that in lieu of the old passport I can instead provide a police case number as proof that I have reported it missing. I don't know what to do now. Is there another way to verify the date of my arrival in the UK? Surely an electric record was kept by Immigration when they let me in?

Indefinite leave to remain to become citizen- questions

Hello All, I’ve had indefinite leave to remain since 2002. I moved over from the US in 2002 and have finally started to think about going for my citizenship in the UK, I’ve lived here the entire time.

I understand there are milestones that need to be achieved before citizenship will be reached.

Do I need to take the living in the Uk test?

I understand that as an American passport holder I’ll be exempt of the English exam. Is this correct?

What are the expected costs? Β£1330 for naturalisation and Β£80 for a ceremony? Anything else or costs that I should be aware of?

Is there any benefit of doing the application online?

ILR (Indefinite leave to remain) Application Timelines - Share your Experience

I am applying for ILR via the Tier 2 route (5 years on Tier 2). Can anyone please let me know how long did they have to wait after the Biometric appointment? According to the Home Office, it can take up to 6 months (!!!) to get a decision. The thing is that the Priority service is currently suspended and it's unclear when it would resume. So please share how long did take the Home Office to get back to you with a decision after you attended the Biometric Appointment.

I'm a university student from the EU. I'm doing a integrated masters with a placement year so I'll be here for 5 years just for my course and the placement. However I live in university dorms which are technically leases and not renting. Will these years count towards the status or will I be at basically 0 at the end of it?

In theory, could the EU offer the UK an indefinite extension to A50? What would be the issues of this from a Leave and Remain perspective?

This might be a stupid question, I'm just curious.

In order to stop anymore extension requests, the EU could simply give the UK an indefinite extension that could be terminated at anytime if the UK votes for a deal, votes for no-deal (let's say the conditions for that would be to give a notice period), revoke A50, have another referendum etc.

Thus it would be completely up to the UK whether or not to leave with no-deal, it would effectively get rid of a countdown to no-deal as well.

From a UK perspective I don't see why either side, leave or remain would be unhappy with this.

The only problem I see here is that the EU would have to alter A50, although A50 doesn't explicitly rule this out.

Article 50 in relation to an extension states:

> unless the European Council, in agreement with the Member State concerned, unanimously decides to extend this period.

It doesn't state that there needs to be an end date to such an extension.

Thoughts?
