On Wednesday, Michael Cohen testified in front of the House Oversight Committee.
In Cohen's opening statement (PDF warning), he made direct reference to Donald Trump communicating to him to lie to Congress, however notes it was not a direct order:
> Mr. Trump did not directly tell me to lie to Congress. That’s not how he operates.

> And so I lied about it, too – because Mr. Trump had made clear to me, through his personal statements to me that we both knew were false and through his lies to the country, that he wanted me to lie. And he made it clear to me because his personal attorneys reviewed my statement before I gave it to Congress.
I'm confused by Cohen's comments and how this mixes with what the Special Counsel has said.
BuzzFeed News put out a report earlier this year that Cohen had been "directed" by Trump to lie to congress. This would seem like obvious subornation of perjury for the President, but then the Special Counsel put out a statement disputing this.
With Cohen's testimony, he affirms the idea that it was not a direct order, but also says he clearly understood what Trump wanted.
Does this constitute 18 U.S. Code § 1622, subornation of perjury for the President?
Back when everyone was wondering why Adnan didn't take the stand in his defense, I was interested to learn that defense attorneys often don't put their clients on the stand not only for strategic reasons (they will get destroyed on cross), but also that putting a client they know to be guilty on the stand to lie opens the attorney up to subornation of perjury issues. The idea was that if Adnan had confessed to CG, then she legally (ethically?) couldn't have put him on the stand to deny his guilt.
Given the excellent analysis by Susan Simpson on her blog regarding Jay's "timeline" and his problems as a witness, and the fact that we all feel that whatever happened that day, large pieces of Jay's story are simply not true, is the prosecution dancing close to subornation of perjury?
I am not a lawyer, so I am interested in the legal community's view on this paradox. It seems that everyone acknowledges that many people lie in courtrooms--almost by its very nature; prosecution and defense can't really completely agree on the facts at hand. And people seem to dismiss lying as "shading" or "trying to minimize participation" or what have you. Not that big a deal.

The cell-tower tests the prosecution ran didn't match Jay's story (and yes, even though today we realize how problematic this type of analysis is, I am led to believe that at the time of the trial it had not been discredited), but the prosecution simply omitted this information.
*Jay's testimony (according to SK) was much more polished in trial #2 than trial #1-- someone worked with him?
So if the prosecutor is given a witness like Jay, who is clearly not completely forthcoming, what are the legal implications for subornation of perjury? Can the prosecutor really just say "I wasn't there, so hey, what do I know?" and put Jay on the stand? Can a prosecutor find Jay's story "true enough" if not all true?

- I tell her she could Wild Shape and carry both.
- She does that and runs.
- Ranger's player is eternally salt that there was even a moment's hesitation.
- I'm still running DoppelRanger. He still kinda styles all over Ranger whenever a fight happens.
First off, DON’T GET ANY AMMO MODES OR ELEMENTAL POP. Also I recommend the Milano because of the slow fire rate/ higher damage combo make it easy getting your tempest low health (also it’s arguably the best SMG in OB overall against Orda and what not). Secondly, tempests don’t spawn in naturally until world 3. So on 1 and 2 get through the worlds asap. However if the world events that include: the golden cest, the free perk and sometimes the fury crystal are in your game, do them bc they have a chance to spawn in additional tempests. Now other tips for actually getting the kills. Get your target low by first shooting their chest to reveal their weak spot. Once they’re chest is open you can shoot them in the legs to get them lower if needed. Once they’re decently low health run away from them. When you run away, the tempests will teleport in front of you. Once they teleport try to kill them as fast as possible. If you miss some shots or they just didn’t die because they were too high health just continue running to force them to teleport in front of you again and repeat the process. Once you’ve gotten to world 5/6 go ahead and exfil and restart to make it easier on you. It should take you around 3 games with this process.
