President Joe Biden created the bipartisan commission in April to study proposals to reform the Supreme Court. Its membership consisted largely of law professors. The report stated there was “profound disagreement” among commissioners over adding justices to the Supreme Court.
Supporters of the idea that wanted reform “contended that court expansion is necessary to address serious violations of norms governing the confirmation process and troubling developments in the Supreme Court’s jurisprudence that they see as undermining the democratic system.”
“Opponents contended that expanding—or ‘packing’—the court would significantly diminish its independence and legitimacy and establish a dangerous precedent that could be used by any future political force as a means of pressuring or intimidating the court.”
President of the American Bar Association said he applauds the work of the Presidential Commission on the Supreme Court of the United States. The comprehensive report it has issued presents important context on the complex and critical issues surrounding the structure of the Court.
The Commission was tasked by President Joe Biden to provide an account of the current debate over the “role and operation of the Supreme Court in our constitutional system,” and to analyze arguments for and against Supreme Court reform...An independent judiciary is necessary to ensure respect for the rule of law and confidence in our courts. The ABA remains committed to upholding the Constitution, the judicial process and equal justice under the law.
Could the Commission have done more or taken a stronger position with respect to term limits and or expansion and was that even possible given the Constitution?

Oral arguments give the Judges, who decide the case, an chance to ask to Shitadel and the SEC about their position and how it should be ruled.
Each side has already filed a written argument and submitted it to the Court before the hearing and everyone knows what issues are in dispute. (Smooth brains: an “Appellate Brief” is what the written argument is called and the Judges will refer to it often during the hearing: “in your brief you say…”)

DC Appeals Court: Monday October 25, 2021, there are 3 cases up in front of a 3 Judge panel, Judges Rao, Walker, Sentelle, in the will hear and decide the case. Citadel Securities LLC vs SEC is 3rd on the court docket so they might be the last case to get called, or the first, don’t be discouraged.
Each side has “10 minutes” to argue their position, but most times they’ll just start to talk and the Judges will jump in and ask questions. It often goes longer than 10 minutes for each side, but you get to hear some of the thoughts and ideas the Judges have that may or may not have been argued by the attorneys.
The Court (the Judges collectively) will later issue one decision or ruling. Idk how quickly they usually issue their decisions, but it’ll be available online when they do.
