Could the Commission have done more or taken a stronger position with respect to term limits and or expansion and was that even possible given the Constitution?

Oral arguments give the Judges, who decide the case, an chance to ask to Shitadel and the SEC about their position and how it should be ruled.
Each side has already filed a written argument and submitted it to the Court before the hearing and everyone knows what issues are in dispute. (Smooth brains: an βAppellate Briefβ is what the written argument is called and the Judges will refer to it often during the hearing: βin your brief you sayβ¦β)

DC Appeals Court: Monday October 25, 2021, there are 3 cases up in front of a 3 Judge panel, Judges Rao, Walker, Sentelle, in the will hear and decide the case. Citadel Securities LLC vs SEC is 3rd on the court docket so they might be the last case to get called, or the first, donβt be discouraged.
Each side has β10 minutesβ to argue their position, but most times theyβll just start to talk and the Judges will jump in and ask questions. It often goes longer than 10 minutes for each side, but you get to hear some of the thoughts and ideas the Judges have that may or may not have been argued by the attorneys.
The Court (the Judges collectively) will later issue one decision or ruling. Idk how quickly they usually issue their decisions, but itβll be available online when they do.
