Ku Klux Klan in Kansas in 1920s
At its peak the Ku Klux Klan, a white terrorist organization, boasted 4-6 million members or 15% of Protestant native-born white men in America. It was so powerful it even controlled state governments in the South, and other states such as Kansas, Indiana, Oregon and Colorado. Its lynchings, cross-burnings, and parades terrorized Black people into continuing to submit to Jim Crow segregation and racial discrimination.
In the early 1920s the Invisible Empire successfully took over the Kansas Senate and many seats in the House. Plus, both a Democratic and a Republican governor were elected with Klan support and were probably controlled by the organization. That is why nationally-known Emporia newspaper editor William Allen White ran as an independent for governor in 1924βto fight the influence of the KKK. The Klan, he said, was directing terror "at honest law-abiding citizens, Negroes, Jews, and Catholics." The attorney general ruled that the KKK needed to have a charter to operate in Kansas. However, the charter board refused to grant it and the Kansas Supreme Court affirmed this and the the KKK was unable to get the legislature to pass a bill modifying the charter board, so the organization gradually faded away.

His only opponent in this election was David Duke, Grand Wizard of Louisiana Ku Klux Klan. Edwards won and, a decade later, he went to prison for 10 years.

It's the middle of the night and the Ku Klux Klan has just arrived at my house and looking to do harm. I have right to bear arms and a right to self-defense, so I start blastin'. Do I have any type of protection under the law in the Jim Crow South? Am I arrested the following morning?

Let's assume 3 different scenarios:

I fire into the air to let them know I am armed.

I fire and injure someone. Do I now have evidence for self-defense? Bob just coincidently got shot in the shoulder last night . . .

I fire and kill a Klan member. I just pissed off the entire town, but I was well within my rights to defend myself and family. Am I arrested?
