Ground C: Procedural Impropriety:
Upon expiry of the twelve-month period, BFSβs application for a renewal of its licence was refused, without the council giving BFS prior warning that the Council intended to refuse it, hence BFS was not given the opportunity make a written representation rebutting the reasons for refusal, to the council prior to the council refusing to renew the license. Common Law / Natural Justice requires, to ensure that decisions are made fairly, that the right to be heard (to hear the other side) is adhered to in all cases including in administrative cases. This is because without listening to both sides a decision maker cannot fairly decide on case.The Right to be heard is to allow the other side to propose a defence/ to make representations to rebut any allegations prior to a decision being made. In this case, BFS did not have the opportunity to make a written representation to rebut the reasons given for the refusal to renew the licence, hence they were not heard. Therefore Southwark Council, by not giving that opportunity; breached this aspect of Natural justice; the right to be heard, so their decision is void. I
