Ashley not filing for Jay’s adjustment of status: isn’t the immigrant the petitioner? Shouldn’t Jay technically be the one filing his AOS (not Ashley)?

So, i didn’t come to the US on a K1 visa, but I am an immigrant who married an American and applied for a green card (=adjustment of status from whatever status you had before to permanent resident). On my adjustment of status application, the petitioner was me (the immigrant). I was the one filing an adjustment of status. My husband (American citizen, my sponsor) was not the petitioner i.e. the person applying for AOS. He did have to fill in and sign the affidavit of support as part of my adjustment of status). I’m confused as to why the show and people on this forum keep saying: it’s Ashley’s fault she didn’t file his AOS. She’s not the one supposed to file the AOS since she’s not the one applying for a green card, Jay is. I assume Ashley just meant she refused to sign an affidavit of support as part of his AOS. Is it different for people who file for AOS from a K1?

Ps. This is not to defend Ashely in any way, she still absolutely sucks. Not sure why I’m being downvoted for a technical question???

Can someone in the process of an adjustment of status file for unemployment?

My husband read that he will be furloughed soon from Disney. He has a q-1. We are in the process of filing an adjustment of status for him to get his green card. Would applying for unemployment make him a financial β€œburden” and disqualify him from getting a green card? I thought I read somewhere that they couldn’t be a financial burden. I’m not sure. Someone smarter than me please help.

Opening a US Checking Account with pending Adjustment of Status

Hello Reddit community!

As the title suggests, I'm looking for some advice on opening a checking account in the US please (preferably online but if that's not possible, I'm open to other options!).

The banks that I've seen great reviews for on here (such as Discover, Capital One) all say that the applicant needs to be a US Citizen / Resident / Person. I have recently applied for an Adjustment of Status to become a US Resident, and this is still in the early stages.

I tried contacting Discover about my current situation and they wouldn't give me an explicit answer on whether I would be eligible to open an account with them, which has made me feel a little sketchy. One of the application questions asks if you're a US Citizen or US Person, and if you select "No", you can't continue with the application. The person I spoke with kept alluding to answering "yes", but just wouldn't commit to it (I just wanted them to say something along the lines of "you can select option yes as you're currently in the process").

I have an SSN already.

Just wondering if anyone has had a similar situation in the US, and if anyone has come across any banks or institutions that are willing to let you open a checking account?

How does the travel ban affect adjustment of status?

My fiancΓ© is from Nigeria and I’m a US citizen. He is currently in the US on a F-1 visa, graduated on OPT. We recently learned that Trump may expand the travel ban to include Nigeria. We planned to have a civil ceremony next month and apply for adjustment of status (I-485), advanced parole, etc.

If Nigeria is added to the travel ban, is that automatic denial for adjustment of status? How does the travel ban currently affect people who are already in the US and apply for adjustment of status?

Advice on how to send photos for evidence of a bonafide marriage? (Adjustment of status)

I've been told that sending regular 4x6 photos printed at costco (and put in a ziplock bag) is not a good idea and that I should just paste pictures onto a word document and print them out on my printer on regular letter paper.

Adjustment of Status Inside USA, How?

I came to an US territory illegally in the 90's, my daughter is above 21 years old and was born in the USA. She has autism, and diabetes and needs me to take care of her. I want to adjust my status without leaving the US because there's no way I could take care of my daughter and buy all her medicine in my home country. How can I adjust my status inside the USA? Question for Status of Adjustment

Hi everyone

I'm fairly new to Reddit, but I had a lot of unanswered questions and I've been going through the /r/DACA for quite a bit now and I wanted to see if I could get some answers.

First, let me give some background info, I had sent an application for DACA renewal, but for whatever reason, it was denied. My lawyers said it was under the discretion of USCIS and they would look into it, but at this point, I don't have much hope. I have no prior criminal history nor am I ineligible for DACA. I've had status under DACA since 2013. In 2015 I was granted advance parole and have a legal reentry permit. I'm currently a junior in college and I'm just really stressed about the whole ordeal. I work and have a paid internship lined up for the summer. I understand I will probably have to forfeit the job as well as the internship soon to avoid breaking any federal work laws.

My question is: If my DACA expires, and I get married. will I still be considered on the Fastrack with DACA to get a green card?

Please if you have any insight about this, please let me know. I, along with the majority of you guys have gone through a lot in this battle. I feel as if the best thing we can do right now is to have full knowledge of our situation and tackle each problem as it comes. I would like to thank you in advance for any information you will be willing to provide.

Needing EAD, Adjustment of Status, Advice desperately needed

First, I acknowledge I made major mistakes based on fear of being deported and misinformation and I should have acted earlier. It's been a hard lesson to learn and I'm currently paying for it. The information of my early life comes from my nearly 70 year old father with some memory issues. Mother passed away 12 years ago.

My story: I was brought to the US by my parents in mid 80s as a 5 year old on a tourist Visa. We overstayed. My father was able to get some sort of EAD through his church at the time and applied and was granted a SSN/card for myself at the local SSA office but nothing else was done for my mother or myself. I managed to get a valid driver's license from a learner's permit.

Using my SSN and DL, I was able to get jobs in food service and retail without problems BUT because I didn't know my actual legal status I was marking "citizen" on applications and the information was being marked on I-9s. I worked at a large retailer for 15 years, got married to a US citizen and had 3 kids. I was downsized at my long term job. When I applied for another job in 2016, I received an e-Verify Tentative Non-Comfirmation notice saying that my citizenship status didn't match records. I went to the local SSA office and the clerk quickly cleared the issue without explanation and I was able to continue in my new job. I eventually lost that job and have been unable to get another job for over a year.

I finally had an initial consultation with an immigration lawyer about starting my adjustment of status through my wife (getting an EAD along the way) but he brought up the problem of misrepresentation of citizenship making me inadmissible. He adviced me to wait since the risk of getting an order of removal through the AoS employment history investigation could bring up the citizenship TNC from my last job. He suggested I get a second opinion. This was a huge blow for us because we desperately need my income.

So what do I do? Do I have any options for legal employment or residency/citizenship?

TL;DR: Arrived and overstayed on tourist visa when I was 5 in '85. Got driver's license and SSN/C. Got married to US citizen, have 3 children. Only now tried for adjustment of status through wife but have been misrepresenting myself as a citizen on job applications. Am I SoL?

F1 visa adjustment of status questions

My wife and I (citizen born in another country) recently got married and have a few questions... we are filling out I-130’s and doing some research before we file. 1. Do we need a lawyer or to pay one of those services that help put packets together? 2. If I mess up on the paperwork, will they let me revise and resubmit or does the process start all over again? 3. I read there is a format they want the documents in,.. is there a resource for this information without paying someone? 4. How long until she gets a ssn? 5. When can she stop going to school?

We had our adjustment of status interview, reviewed two emails this evening about our case?

A little background. Im a US citizen. My spouse and I met in school and she was on a student visa. We married and decided to convert her student visa to a marriage visa. (Take my word for it, we are in love.) I'm am a supporting her and she has her EAD card.

So, we have two questions:

  1. Our interview officer did not recommend our case for approval but checked the second box, "A decision cannot be made about your application/petition."

  2. We received an email confirming our interview and then a few minutes an email telling us about a "new card" being made for my immigrant spouse.

Without scaring us, would could these two developments mean?

EDIT:

The interviewer said he thought we had a strong case that he wanted to review our case one more time before making a decision. They suggested we'd be fine.

Adjustment of status and form I-131

Hello, I am adjusting my status through marriage. I am filling out form I-131 because my husband and I are planning on visiting my home country a year from now. However, what worries me is what I read in the instructions for this form. It says

"you may apply if you have a pending application to adjust status, Form I-485 and you seek to travel abroad temporarilyΒ for urgent humanitarian reasons, or in furtherance of a significant public benefit which may include a personal or family emergency or bona fide business reasons".

We'd travel just for pleasure. What does the above written mean?

Marriage Interview/Adjustment of Status Interview Being Held in Another State?

My wife and I live in a suburb of a major city about 45 minutes or so from the USCIS office and just received our interview notice for an interview at their office in a neighboring state about 2 hours away in a much smaller city. Curious about Adjustment of Status, Terrified of Accidental Fraud - xpost to r/legaladvice

My husband and I need some advice. I (American citizen) am in the process submitting CR1 for my husband, who is Brazilian. We got married in Brazil in August 2018. At that time, we decided to pursue a CR1 visa. We hired rapidvisa.com to review and mail our documents and we have not filed the petition yet. My husband arrived in the US with a B2 visa planning to make a temporary visit and stay up to mid June before going back to Brazil. He got heavily questioned by CPB in Chicago before being allowed to continue on his way.

Since he arrived, we’ve been preparing documents to complete our CR1 petition, such as getting a joint bank account, joint car title, and joint car insurance. Now we are realizing just how much longer the CR1 could take and he started asking about the Adjustment of Status instead of the CR1 process. We have most of the documents required for that petition as well. Obviously we want to stay together because long distance just totally sucks, but as far as I was aware, applying for AoS while on a B2 was an automatic no. I am very afraid of accidentally committing fraud or something worse and having my husband basically permabanned from reentry and deported to boot.

Some additional relevant info - hubs didn’t even quit his job back in Brazil and has been teleworking during his stay here. He has no written documentation of his agreement with his boss to telework for around 2-3 months, but maybe we could get that. He has a return flight and short term travel insurance with an end date. He hasn't transferred any of his funds from his bank accounts, left most of his possessions at home, and has yet to pick up his college graduation diploma. His family is expecting him back.

We want to get legal advice on whether we would be committing immigration fraud or not by filing for the Adjustment of Status in this situation, and how to prove the authorities in the best way possible that he was truly with the intent of doing a temporary visit but we changed our minds. At what step of the process do we need to prove our case? Do we include documentation of prior intent to return with the initial petition, or just bring it to the interview?

Thank you for all of your help. I'm a bundle of nerves with this possibility.

tl;dr: Hubs is here on B2 and we like it, want to change from initial plan of CR1 to AoS. Is it legal?

Can you quickly get a drivers license(FL) from marriage while adjustment of status is pending?

I've found some articles and they can be pretty confusing, I was hoping there might be someone here who has already done so. I plan to marry my Brazilian girlfriend very soon who is a bit expired on her I-94 now, she does has a Brazilian license. One we have a marriage certificate and a pending i-485 will she be able to get a FL drivers license with that?

Adjustment of status for F1 students on OPT to PR/green card application

ISO legal advice/U.S. laws regarding immigration and/or adjustment of status:

If someone is currently under a student visa on an OPT (that is ending mid 2019) and hopes to continue working with the employer by adjusting status through marrying a citizen and then applying for a green card (plus work authorization to be able to continue working after OPT ends);

  1. how early/how soon should they consider signing/register marriage as well as submitting application for green card?

  2. What is a good time to start the process to ensure that at least the work authorization is available before OPT ends?

And probably a naive question to ask but how important is it to have an immigration attorney to help out with it (asking mostly because of $$$ constraints)?

Got married and had our adjustment of status interview, here's our experience!

Me and my wife just got home from our interview with immigration services for her green card at the Louisville Kentucky branch. I wanted to document our experience and hopefully help out others whose interviews are upcoming after breaking the long distance.

We arrived to our 1030 appointment at 1000, wearing business casual attire. I (petitioner) was asked to give my license and my wife (beneficiary) was asked for her passport (U.K.) and had to take a picture along with a finger print. They kept our IDs and told us we would get them back during our interview. We were not called back until 1100.

The officer swore us in and had us sit in front of his where we were informed that we would be recorded and he pointed out the little Webcam on his desk (we had to scoot back a bit). He went through the paperwork, asking my wife our address and the list of yes no questions from the AOS form. The officer lightened up the mood when he asked her if she ever caused intentional harm to someone, adding on, "and minecraft doesn't count" with a laugh. So he knew from our file how we met, playing minecraft.

He also asked my date of birth and where I was from before asking my wife when we got married. After confirming the info on the AOS and having her sign it, he asked her for proof of residency at my address. We gave him all the bills in our shared name from our evidence folder (it was a very full folder). After that he asked how did we meet, joking again, "Well I know you know that I know, but how did you two meet?" We explained how we met on minecraft briefly and how we visited back and fourth up until I proposed.

When that was done we were expecting questions about our relationship or requests to see proof. We had brought a lot off stuff for that, but he didn't ask for any of that! No photos, no statements, no questions about me, no questions about our lives. Didn't look at our marriage certificate or paperwork copies. Nothing more. He said, "Well you(wife) already had the interview for the K1, I'm going to go forward and approve you for a 2 year conditional green card since you haven't been married for two years." He told us that it use to take 3 months to get it, but recently it takes about 2 weeks to get to us in the mail. He told us to call the 1-800 number if we don't get it in a month.

My wife asked about what name would be one the green card. Our marriage certificate has her maiden name but all the paperwork was done with her married name. H

Has anyone had their marriage based (spouse is USC) interview in NYC recently? If so, when is your PD?

My PD is early May 2017 (today is actually the 1 year mark) and no interview notice yet. My online status actually still just says case was received..nothing about interview is ready to be schedueld.

Quick question about Adjustment of Status (i-765)

My wife entered on a K1 visa (Fiance Visa), we got married within the 90 days and have been married for a couple months now. We had to save up to file form i-765 and now that we are I am wondering what to list as her "Current Status"? I would assume she would still be classified as K1 status but that doesn't make sense to me since she is no longer a fiance. I just wanted to see if anybody can help. I don't want to make an error on the form and waste money. Any help would be appreciated, thanks.

Adjustment of status greencard

I'm applying for a greencard through my spouse who is an american citizen. I entered the US on a F1-visa in 2013 and fell out of status in 2014 and I recently got married this year and my wife is sponsoring for my green card. I'm going through an immigration lawyer and my paper work is done for the most part except waiting on my medical examination report i-693 will take about 10 days. The problem is my Indian passport is going to expire in 7 days and the Indian consulate said they are not going to renew the passport if there is no legal status in the US. So, I researched a little on the web and found some forums where people said it does not matter if the passport is expired or not. So, my question "does it matter if the passport is expired or not?"
