Someone backed in to me yesterday and said he would take care of the damages. When I got the estimate of course he back tracked and said he has a guy. I called my insurance and they ran his plates and it came back that he was uninsured. My insurance company CAA is willing to take care of the damages and has deemed me 100% not at fault but they're saying I'm still responsible for a $300 deductible because he's uninsured. They'll try to recover that from him but I still need to pay that for my claim to move forward. Is this normal and the same with every insurance company? My friend with TD said the same happened with him but he didn't have to pay a deductible. I have colission and liability with every endorsement possible.

From what I've read it just steps in, in case the person at fault is not insured (enough).
Depending on the situation it will cover your medial expenses from the accident, your car and even compensate if you missed your job because of the accident.
But what I don't understand is, is the other person just let off the hook?
Will they have to pay your insurance back?
IMO it would be pretty unfair of the other person would just have to pay a fine for not being insured, while your insurance covers their wrong doing.
Did I understand that concept correctly?
How is your experience with uninsured motorist coverage and do you (still) have it?
FL - Uninsured Motorist is not required. Everything I have read suggests that UM is about paying medical bills, loss of wages, and pain/suffering for the driver / passengers when the other drive is at-fault and does not have enough (or any) coverage.
So carrying too little UM would only get the medical insurance off the hook for medical bills, right? I would have to carry enough UM so that after the medical bills were covered, loss of wages and pain/suffering would kick in. Even in that case, how is pain/suffering determined? Hopefully not by the insurance company that has to pay out.
It makes me think that the only way UM is valuable to me is to carry a lot, but $250K/$500K non-stacked is running me about $800/year for two cars. Am I better off letting my medical, STD, LTD, and ADD through my employer cover me instead of UM?
Please let me know what I am off on here, as I am not an insurance expert. Thank you kindly.
I am setting up my auto insurance and they said OK doesnβt have uninsured motorist. My car is older, so I donβt need full coverage, but the only times I have ever had an accident were by uninsured drivers. I just want to cover that possibility.
I'm in California and I was rear-ended by an uninsured motorist in September. She provided me her driver's license at the scene and asked if we could settle the situation without going through insurance. I stupidly agreed and went to get a repairs estimate at two different shops. When she hears that the damages are between $2500-$3000, she then admits that she doesn't have insurance and eventually stops responding to me after I said that I'm going through insurance. I file a police report and a report with my insurance that night. Fast forward two weeks, my car's back with me but I'm responsible for paying my 1k deductible. This is the money I want back.
Last month (November), I decide to go the way of the court after basically hearing no big news regarding getting my money back from my insurance (last I checked with them they reached out to the DMV to suspend her license). I got a court date and everything set and then proceeded to go with a process server company to make sure things are done right. But lo and behold, the process server reports that she no longer lives at the address on her license and hasn't for two years now. So here's where I'm stuck....is it worth going through skip tracing to locate her to serve her papers? And even if she does get served and if I win the case, will I even get my money back or is there nothing to take given that she doesn't seem like she has much to her name anyway? I figure if someone's driving an uninsured vehicle they're probably broke to begin with. I'm having trouble seeing the prospective outcomes down the line as I've never been in this kind of situation before...I've already sunk $140ish into court-related things and I'm reluctant to keep shelling out if it's not worth it in the end.

Repost: I am an educator and was outside with my students on the playground when a 4x DWI offender tried to run over my students and me. I got them safely out the way, but have herniated discs, etc - been in treatment since February 2021. The guy is in jail for 5 years. My medical and medicine are paid for by Workman's Compensation, but whenever I have to take off work for a procedure it is LWOP; I always provide a doctor's excuse to my employer and the claims department. Been through steps 1-7 listed below will have a nerve block put on Dec 6, 2021. I was told to go through my uninsured motorist and file a claim, but I feel I was not the one at fault, and my insurance will go up if I make this claim - I live in Louisiana. I see no end in sight. Any advice? My employer is patient with me, but I have missed so many days of work and not getting paid. Also, I think she will eventually have to replace me because of all the missed days.

Some pertinent information before I launch in here, I'm located in Indiana and have a policy with Stillwater Insurance through policygenius. I have collision coverage on my car.
My car was hit in a parking lot while I was getting groceries last week. The driver drove off without leaving a note or anything. I've never been involved in an accident before, so I'm feeling my way through this whole process. I made a walk-in accident report at the police station with the hopes that they would be able to get the security footage of the parking lot from the store. I don't have high hopes about this route if I am being honest.
I talked to my adjustor yesterday and he informed me that even though I have uninsured/underinsured motorist coverage that it wouldn't kick in here because of how an uninsured motorist is defined. (He read the definition but I have been unable to track down the definition he read). Essentially the logic seemed to be - I don't know whether or not the motorist was uninsured, therefore I can't claim uninsured motorist coverage here. Is that right?
I'll be happy to provide more information when necessary, ultimately I have a $1000 deductible on my collision but that would go down to $300 if the uninsured motorist coverage kicked in. Do I have any recourse in this situation?

I commute on my Radwagon 4 daily, and I've been thinking about what happens in the event that I'm hit by a motorist. I was reading about why cyclists should double check that they have good coverage for uninsured/under-insured motorist (UIM) on their auto insurance policy, as that policy may apply if a cyclist is hit by such a motorist. It seems this use of that coverage depends on the state, because when I checked if it applied with my insurance agent I learned it doesn't. HOWEVER, I was able to get a policy for my Radwagon 4 that is separate from homeowners insurance (separate, cheaper deductable), includes UIM coverage, PIP coverage, and replaces the bike if it were to be stolen. It is actually a motorcycle policy, but it works in my case because the bike has a throttle. Just putting this out there in case anybody else decides to contact their agent.
Las Vegas Nevada, I was on my way to work two days ago. I stopped at a Crosswalk to let a pedestrian cross. The lady behind didnβt. Turns out she had no license or insurance also had her toddler in the car. She was ticketed. The car was registered to someone else but I donβt know if they have insurance.

(California) I was in a crash with an at-fault uninsured motorist. My car was sent into an auto-body shop, and my insurance company told me that I would not have to pay the deductible since I had the uninsured motorist collision deductible waiver. However, after the body shop gave a repair estimate, the insurance company deemed my car a total loss. They told me an amount over the phone but when I received the paperwork to sign, the amount had my deductible subtracted from it. I got the paperwork on Saturday so I couldn't call the insurance company, but I wanted to make sure I know what I'm talking about when I call them. My family and I live in Mississippi. My mother was returning home from an overnight shift at the hospital taking care of covid patients. A man fleeing from police went down the wrong side of the road and crashed head-on into my mom killing her. My brother talked me into hiring this injury lawyer to investigate our case and see if we can sue anyone's insurance like the driver of the car that killed our mother. The lawyer assured me he was about to have the smoking gun (videorecording) he needed to sue the police for recklessness and convinced me to sign (no insurance on other driver). Turns out, he had already had the video before I signed knowing full well he had no case. The next day he comes out and says it. The contract which I do not have in front of me is a contingency-based fee. With no one to sue, he presses on to start collecting on my mother's auto insurance. She had uninsured motorist on her insurance as well as funeral coverage. His secretary contacts my brother through email talking about claiming on her car insurance. My brother told her that we will pursue the auto claim ourselves since it's so cut & dry. The lawyer responded very quickly and I quote " Iβm handling the auto claim.Β Thatβs what I was hired for. You have the estate claim, all the life insurance claim(s) and whatever else. Is there some confusion on this front?". I am finding this out yesterday on a Friday before the lawyer gets off work for the weekend. I have sent him an email for a copy of our contract. I am writing another email informing him to stop working and send over a copy of our file to see what he has done so far. Now I need advice. Since there is no one to sue, it's going to hurt us more than help us having him handle the auto claim. If I end the contract could I possibly get out of paying this guy for the work he put in on the auto claim? Can I refuse to pay him and go to court and request a jury that will see this guy is just trying to get a quick buck on our family tragedy? Any advice would greatly be appreciated by myself & my family. Update: 100% contingency based and me nor my brother ever gave him permission to inject himself into processing our dead mother's insurance claim. We only told him to investigate and see if a lawsuit with the other driver's insurance or possibly the police for recklessness. He came back with a "No" on both hours after I signed.

If an uninsured motorist does $3500 to my car. Would my insurance company pay me that from my uninsured motorist property damage coverage or would I have to pay that amount myself since my collision deductible is $5000?

Title same as the body, a drunk driver managed to flip and crash his car onto my lawn the other day, finally got a copy of the police report only to find out he was uninsured.
Whatβre my options moving forward? He didnβt hit the house or any other structures, however, thereβs enough torn up lawn and glass everywhere that I donβt even want to touch it, much rather have him pay for the damages he caused and get a cleanup crew to do the job.
I do have home insurance (Eerie), and I assume I would call my agent to see what could be done. Albeit whether or not my premium would be raised because of it worries me.
Do I have the option of small claims court to deal with it personally, getting the money from him to repair and cleanup my lawn?

I was hit by an uninsured unlicensed car a few weeks ago and because they were insured I need to pay my $500 deductible. Iβve been driving my husbands car then today it stopped going in reverse and the entire back tire is locked up. We canβt afford to fix that either or take it in to be looked at.

I came here to legitimately get opinions on if I was the asshole or not. I wouldn't have posted here if I didn't want feedback. I had doubts that I handled the situation well, that's why I decided to post it here and find out. Once the answers started coming in, it became clear that I was the asshole, that I was in the wrong and handled the situation poorly.
I wanted to respond to people's questions with clarification, more info, and my reasoning because I thought that is what the sub was about. I was trying to explain my thinking. I didn't lie, I didn't argue with anyone or start getting super defensive. I was polite and just trying to be honest and answer any posters to continue the discussion.
Many of you gave great advice, made me reconsider my position and see it from a different perspective, and I fully admitted within the first hour that I was completely wrong. I posted that I would contact my insurance company, which I already did, and would make this whole thing right. I listened to you guys and tried to fix the mess I made, but still every response I made is downvoted.
Do you guys want posters to reply to your questions? Every response I made just got me more downvotes. I actually would have been better off just not replying to anything. Is that what you guys want? You aren't encouraging discussion. And people that are considering posting on here can look at examples like mine, and just think it's not worth it to even post anything because they are just going to be insulted even after admitted they made a mistake.

I was rear-ended by an uninsured motorist driving with a suspended license. The accident occurred at low speed while I was waiting to turn left from a side road onto a main road. My bumper was pushed forward and off its attachment points - it's also halfway sheared from the bolts. I'm guessing it will need replaced.
We pulled over and she informed me about her current license and insurance situation. I didn't want to send her down whatever legal spiral would occur if I were to involve the police, and she naturally asked me not to involve my insurance. She offered to pay for the damages.
I have pictures of her, her license, license plate, damage, and the scene.
If she stiffs me, I can afford repairs but am I exposing myself in any way by not reporting the accident to my insurance? I have a document that under my state law I can choose my place of repair and parts used for repair. The adjuster is adamant about after market parts being the only option under the policy. I can understand this being the case under collision/comprehensive, but uninsured motorist too? Should I get a lawyer?
Long story short, I bought 2017 Nissan Sentra SR Turbo and 3 weeks later said person ran a red light and I totaled my car. She was 100% at fault for the accident. Didnβt have a driver licenses nor insurance. After my 10.5 grand down and before I even make my first monthly payment, am I entitled to all that money back and if so, how does that work?
