  • 2/12/2021-2/TBD/2021: The former President Trump’s legal team shall make his presentation for a period not to exceed 16 hours, over 2 session days.

  • Upon the conclusion of the period allotted for presentations by the parties as provided under section 4, Senators may question the parties for a period of time not to exceed 4 hour

I'm wondering if the concept of double jeopardy applies in the case of Trump's second impeachment trial. It seems obvious to me that the current Senate is not an impartial jury. If he were acquitted by the Senate, could he still be charged by the Justice Department for inciting an insurrection (or on other charges) and tried in the Federal court system?
