2/9/2021: Four hours of equally divided debate on the question of whether Donald John Trump is subject to the jurisdiction of a court of impeachment for acts committed while President of the United States, notwithstanding the expiration of his term in that office
2/10/2021-2/11/2021: House Impeachment Managers make their presentation in support of the Article of Impeachment for a period of time not to exceed 16 hours, over 2 session days.
2/12/2021-2/TBD/2021: The former President Trumpβs legal team shall make his presentation for a period not to exceed 16 hours, over 2 session days.
Upon the conclusion of the period allotted for presentations by the parties as provided under section 4, Senators may question the parties for a period of time not to exceed 4 hour
I'm wondering if the concept of double jeopardy applies in the case of Trump's second impeachment trial. It seems obvious to me that the current Senate is not an impartial jury. If he were acquitted by the Senate, could he still be charged by the Justice Department for inciting an insurrection (or on other charges) and tried in the Federal court system?
