A list of puns related to "Legal process (jurisprudence)"
Deleted the previous post cause I linked multiple comments wrong and had a shitty title to boot. Was a shoddy writeup. My fault
This should be much better.
Surprising no one. Wealth is the biggest divide in this country today.
Reddit hating the wealthy is so fucken stupid. It has nothing to do with wealth. They promised him they wouldn’t use evidence against him and they did. The end.
Has nothing to do with wealth. Try actually reading next time.
If he weren’t wealthy it’s exceedingly unlikely he’d have a team of skilled and savvy lawyers who would continue to appeal this up to the state Supreme Court. I don’t think a poor person would get that from a court appointed public defender, no.
The Supreme Court doesn’t only hear wealthy peoples cases.
Sounds like you’re mad that public defenders aren’t very good. That’s a different argument.
Jesus Christ. Not only are you a piece of shit, you are a piece of shit that can't read.
But this overturn had nothing to do with money.
Cosby could afford lawyers day and night for years combing through the case for procedural blips to exploit, and to push the case up through the courts. Very few can do that, it had everything to do with money.
This was brought up during h

I halfway expected someone to make a quick explainer on how this works by now, but still nothing and the news reports do sort of a bad job of informing the public of the mechanics of the American legal system, so anyway...here goes.
Like our good "friend" Derrick, I have only just finished law school, but my focus has been up until this point and will be in the future criminal law. I am mostly cobbling this timeline together on old class notes as kind of an academic view of the subject without a lot of real analysis trying to predict what will happen at a given stage. I just don't have enough real world experience to provide anything resembling intelligent analysis. If anyone has done any serious criminal practice I'd love your input. I just figured it would be useful to have a place to answer some of the process questions instead of politely replying to comment after comment that it is not likely he gets the firing squad next week or that this goes to the Supreme Court. To those sensitive to this topic, I've tried to make this post as clinical as possible.
*I know some people prefer the term "child sexual abuse images" which I didn't learn about until this story broke. I'm going to try to incorporate that into my vocabulary when discussing the subject outside of a strictly legal context, but for now I am sticking with the legally correct term.
November 19, 2019--Duggar Compound Raided
No need to go into a ton of detail here, but armed with a search warrant federal authorities searched the Duggar compound for evidence of Josh's criminal activity.
These are federal authorities looking for evidence of federal crimes. Both the laws of Arkansas (other states could have jurisdiction as well...we just don't know yet) and the laws of the United States criminalize possession and distribution of child pornography. Arkansas could have also charged him, but the federal government was the one to step up and do it. This concept is called dual sovereignty. There are a few reasons why the federal government will prosecute a case instead of leaving it to the states. Sometimes they feel the crime committed by the defendant is particularly egregious and they want to throw the vast resources of the federal government behind seeing that they are prosecuted to the fullest extent of the law. Sometimes they feel that a state is doing a poor job

I don't know how to look for it, but wanted to know if there's a (theoretic) way for justice system / opposition / president to remove a ruling party from the office and either have president rule or fresh elections?
Again, I'm looking for technical details or guidelines laid down for this process... and not whether it is possible in the current scenario.
Can someone point me to the right direction?
So my mother gave me her cheesecake recipe that is really good. I've recently started making them for my roomates. I know that they are good, I just need to get good at making them. If you know how i might get a license to sell them or know a store in north little rock that might buy then I would love to make a bunch.
My fiancé and I are torn on whether to pursue legal action with our venue. We have paid $15,000 worth in deposits - 50% of the contract broken into 2 instalments. We are hesitant to proceed given that we are already out so much money and would only consider doing so if we have a good chance of getting all or most of our deposit back.
Currently the lockdown in Ontario is suppose to lift on June 2. The event date on our contract is on June 5 making it near impossible that the restrictions would be lifted to where the venue can successfully service their end of the contract. The venue refuses to provide any sort of refund as we were open to a compromise, just not willing to lose all of $15k. The act of god clause in our contract states:
“(Venue) is in no way responsible for the total or partial lack of performance on its part if caused by strikes, riots, lack of public transportation, lack of utilities, poor weather, acts of god and other causes which are beyond its direct control”
Based on the wording of the clause above, are we SOL? Any advice would be greatly appreciated. Any success stories to share to give me some glimmer of hope? If anyone has any recommendations for a paralegal that’s dealt with this situation in the GTA, that would be much appreciated also. TIA!
See the title. Unionizing by running an official union campaign would be difficult, and it would let your employer have a chance to fight the union and retaliate directly against the organizers (myself included), which is generally bad.
What's the disadvantage to, say, secretly unionizing a chain (i.e. getting everybody in the chain to covertly join the IWW, or to creating a union run on principles of direct democracy).
This wouldn’t be a dating app— this would essentially be the same scouting process as the show. You would be subjected to questionnaires, intensive interviews, and possibly psychological evaluations. However, you would have to pay for the service if your match was found. And there’s definitely no cameras.
If this already exists I’m sorry, pardon me lol.
The article in question. Some of the relevant text:
>Rather than enforce the VRA’s text, Alito effectively crafted a new, vastly weaker statute out of thin air. For instance, he wrote that most voting rules in place when Congress added the results test in 1982 will probably pass legal muster. He dismissed “predictable disparities” between white and non-white voting opportunities that ostensibly result from differences in “employment, wealth, and education.” He insisted that courts “consider the opportunities provided by a state’s entire system of voting when assessing the burden imposed by a challenged provision,” meaning a restriction that disproportionately burdens racial minorities may be lawful if they still have other means of voting. And he wrote that states can justify a broad range of voting limitations by citing their “strong and entirely legitimate” interest in “the prevention of fraud”—even if there is no evidence that fraud has ever occurred in the state.
>Taken together, Alito’s rules establish a brand new test under the VRA, one that bears little resemblance to the law that Congress actually passed.
Would you agree with this specific assessment of his written opinion? Is this hyperbole?
(Not sure if this is the place/is allowed, I looked over the rules so my apologies if not!)
Two weeks ago, my boyfriend sent his income and bank statements to legal aid so they can give him a lawyer/process it. He called today wondering when he is going to get one since it is on Tuesday of next week. They told him they won’t be able to process him in time. Therefore, no lawyer.
We live In Newfoundland Canada and I am currently going through all the available resources for self representing people; because honestly, I don’t know what else to do.
This may be a “dumb” question per se, or perhaps one with an answer that I already know. But we are both new to this and I’d rather be safe than sorry- and post this incase there is something we haven’t already thought of, on what to do.
We will try and get it pushed back somehow, however it’s already been pushed back once or twice due to covid. I’m not an expert but I do believe they could use the “he has had plenty of time to do so” as an argument against this. The only thing we have is showing proof of him currently being processed (I think that’s possible).
Thanks, Vanotomy.
**“Why didn’t he seek legal advice way before?”, you may ask. To quickly summarize, he is young and his parents cast the idea that getting a lawyer is not necessary and they were judgemental towards it. He did not realize how serious his case was at all and was waiting for his parents to say something basically- until I did research and brought it to his attention about how serious things were. I told him that he has to start doing things for himself, even if his parents do not like it, as well. He immediately sought legal aid and now realizes his mistake greatly.
Tough situation and learning moment for sure. But with all judgment aside- it does not change the fact that he does not/will not have a lawyer.
I've searched online, but my brain has trouble understanding how this all works honestly. I'm having trouble forming a concise image of how it works. I wanna hear from anyone who has already been through the process.
I'm just worried because my legal parental unit keeps refusing it because it's not worth the effort and "[deadname] is so pretty though" and lmao that shit hurts a lot.
I wanna start doing doing commissions and stuff again, but because I lost the ability to accept comissions in the way that I used to, I don't know what the fuck to do besides Paypal. A bunch of trans artists I know also have this issue where they are obligated to show their legal deadname on Paypal + it being the most available option for most of us.
This is my long winded way of saying: What's the process of changing your legal name as an 18-year-old. And for a younger friend of mind: the process as a minor? They're having the same issue as me.
As stated in the Cares act there is no option for the government to not pay PUA benefits to those that would qualify for them. unlike PEUC there is no ability to opt out for states, and these benefits must be paid under the law. There are already lawsuites in the making in case things get that far, but hopefully the fed, and board of Labor do their jobs and steps in to put a stop to this shit.
Governor Hotwheels shouldn't be able to cancel these benefits just because he is afraid that his Subway franchise will have to pay a competitive wage. Fuck him, and fuck the entire republican party for even attempting this shit.
For the NC-110 form where it says “Born at (place of birth)”
Do I put the city where I was born? Or the address of the hospital and city?
I’ve been married to my Japanese husband for almost 2 years and I need to renew my passport and zairyuu card within the next few months. I want to go ahead and change my last name to his since this is the perfect timing. I am an American living in Osaka. Because I’m an American, I can’t just go to the city office and change my name like a Japanese woman could. I searched online and the conclusion I came to was that I need to first go to the embassy/consulate and request a name change on my social security. Than once that is processed use my new social security card to apply for a new passport with the new name. Than I must go to the city office and change my name on all documents so that I can renew my visa.
Has anyone gone through this process before? If so, I’d be super thankful for some help. The American consulate/embassy website is shit and is of no help.
Fiancé’s sister 16, in Indiana, is being physically abused by her mom. Not like seriously injurious (I’m not diminishing it here!) just saying at this point it’s like hitting during arguments. Which is unfathomable to me. Also being denied desperately needed mental health treatment by her mom. She just came out to her mom and it didn’t go well. She doesn’t want my fiancé to call CPS because she will end up with her dad and “that is worse”. He flies into scary rages. We would love to take her in here and have the means and responsibility to do so. We’re in NY. We have no kids and would be happy to care for her needs and help her through therapy until she is ready to go away to college.
Problem: how do we do this? Her mom absolutely will not consent. Her dad may but only if he gets out of child support payments. (Which we don’t need to care for her) Obviously the matter is pressing so just filing for emancipation in a backed-up court system seems like a bad plan. She’ll be 18 in a year and a half and it’s a moot point then.
I had an email from Facebook claiming a valid legal process seeking information about your Instagram account, this email had a legitimate email address of a solicitor on it so I know it’s real but what kind of information can be taken from this and what is it used for? Is my consent even required for this matter?
Edit: email was from a company called whitecase? And was headed as a BSI notice

I'm wondering: is this legal? Sounds like a very anti-customer thing to do and it's the first time I am facing this kind of process in the EU.
Thank you for your insights.
