I. Introduction
On May 25, 2020, Governor /u/cubascastrodistrict signed into law B.229, the so-called "Child Abuse Prevention and Investigation Act" (hereinafter "the Act"). The Act, defines "child abuse" broadly so as to include:
> Inflicting or causing, allowing, or creating a substantial risk of physical injury, other than by accident, that causes death, disfigurement, impairment of physical or emotional health, or loss or impairment of any bodily function; committing or allowing to be committed any sex offense; torture, excessive corporal punishment, female genital mutilation; giving child access to controlled substances
The Act defines "child abuse" so broadly that providing a child Ritalin, even if the child has a legitimate prescription for Ritalin (or, likewise, providing a child a prescription for Ritalin or filling that prescription, even when medically warranted) could constitute "child abuse."
Operating with this broad definition of child abuse, the Act requires:
extensive investigation by multiple state employees of "any and all cases of suspected abuse", even when the case is determined to be "unfounded";
the creation of a "Child Abuser database," containing "the personal information of the Abuser, including: current location of employment, full name and other known aliases, date of birth, current address, any phone numbers or email addresses known to be associated with the subject, criminal history, name and age of any biological children, or any child living or regularly in contact with the abuser";
any child abuser to provide updated information to the state government for the purposes of maintaining the database.
Furthermore, the Act applies not only to persons subsequently convicted but to all persons to whom the definitions of the Act apply. The Act states that "[a]ny Abuser of Children" (defined as someone ever convicted child abuse as defined above) must have their "information" added to the database and then imposes requirements on any person "added to the database."
II. Ex Post Facto Law
The Act imposes punishment upon persons for acts they have already committed and accordingly violates the ex post facto clause of the Constitution. That provision provides that โ[n]o State shall . . . pass any . . . ex post facto Law.โ U.S. Const. art. I ยง 10, cl. 1. WHEREAS child abuse continues to be a distressingly prevelant problem in Lincoln,
WHEREAS children who suffer trauma are at far higher risk for developing severe emotional or developmental disabilities,
WHEREAS there can be no more important or more urgent priority than the protection of the welfare of our children,
WHEREAS abusers often move between states and other jurisdictions to evade scrutiny and punishment,
Section I: Title
(a) This bill shall be formally be known as โA Bill Expanding Existing Protections for Children Against Child Abuseโ
(b) The bill may be referred to and addressed as the โChild Abuse Prevention and Investigation Actโ
(c) This title may be shortened and referred to the initialism โCAPIโ
Section II: Definitions and Naming
(a) โChild Abuseโ shall be defined as, and shall constitute, โInflicting or causing, allowing, or creating a substantial risk of physical injury, other than by accident, that causes death, disfigurement, impairment of physical or emotional health, or loss or impairment of any bodily function; committing or allowing to be committed any sex offense; torture, excessive corporal punishment, female genital mutilation; giving child access to controlled substancesโ (325 ILCS 5/1, et seq.)

(c) โAn Abuser of Childrenโ shall be defined as โAny person who has been convicted of abusing, neglecting or assaulting any child, or conspiracy to commit any of the above, whether the abuse or assault was sexual in nature or notโ

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
##SECTION 1. SHORT TITLE.
This Act may be cited as the โHeroin and Opioid Abuse Prevention and Treatment Act of 2017โ.
##SEC. 2. EXCISE TAX ON OPIOIDS.
(a) In General.โSubchapter E of chapter 32 of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:
โSEC. 4192. OPIOIDS.
>โ(a) In General.โThere is hereby imposed on the manufacturer, producer, or importer of any taxable active opioid a tax equal to the amount determined under subsection (b).
>โ(b) Amount Determined.โThe amount determined under this subsection with respect to a manufacturer, producer, or importer for a calendar year is 1 cent per milligram of taxable active opioid in the production or manufacturing quota determined for such manufacturer, producer, or importer for the calendar year under section 306 of the Controlled Substances Act.
>โ(c) Taxable Active Opioid.โFor purposes of this sectionโ
>>โ(1) IN GENERAL.โThe term โtaxable active opioidโ means any controlled substance (as defined in section 102 of the Controlled Substances Act) manufactured in the United States which is opium, an opiate, or any derivative thereof. Such term excludes a narcotic drug for maintenance treatment or detoxification treatment if, to dispense the drug, a practitioner must obtain a separate registration under section 303(g) of the Controlled Substances Act.
>>โ(2) OTHER INGREDIENTS.โIn the case of a product that includes a taxable active opioid and another ingredient, subsection (a) shall apply only to the portion of such product that is a taxable active opioid.โ.
>(b) Clerical Amendments.โ >>(1) The heading of subchapter E of chapter 32 of the Internal Revenue Code of 1986 is amended by striking โMedical Devicesโ and inserting โOther Medical Productsโ.
>>(2) The table of subchapters for chapter 32 of such Code is amended by striking the item relating to subchapter E and inserting the following new item: โSUBCHAPTER E. OTHER MEDICAL PRODUCTSโ.
>>(3) The table of sections for subchapter E of chapter 32 of such Code is amended by adding at the end the following new item:
