Emailed my state senator in defense of vaping, got this reply. Looks like Arizona could be safe from the flavor bans that keep spreading from state to state.

The Food and Drug Administration (FDA) is the federal agency responsible for protecting public health by ensuring the security of our nation's food supply, as well as the safety and efficacy of cosmetics, drugs, and medical devices. Since 1938, the federal government has prohibited the sale of tobacco products to all Americans under the age of 18. In 2009, Congress passed the Family Smoking Prevention and Tobacco Control Act, which gave the FDA the power to regulate the tobacco industry, including banning flavored cigarettes, placing limits on the advertising of tobacco products to minors, and requiring tobacco companies to seek FDA approval for new tobacco products.

Electronic cigarettes, also called e-cigs, vape pens, or vapes, are noncombustible tobacco products that produce an inhalable vapor, which typically contains nicotine, flavoring, and vapor-producing chemicals. In 2017, the Centers for Disease Control and Prevention (CDC) estimated that 2.8 percent of Americans were current e-cigarette users, with e-cigarette usage most common among young Americans. A 2018 CDC survey found that more than 3.6 million U.S. middle and high school students had used e-cigarettes in the past 30 days, including 4.9 percent of middle school students and 20.8 percent of high school students. Between 2017 and 2018, e-cigarette use increased 78 percent among high school students and 48 percent among middle school students.

On May 10, 2016, the FDA issued new regulations subjecting all e-cigarettes sold in the United States to the same FDA approval process as other tobacco products. Any manufacturer who sells e-cigarettes without receiving pre-approval from the FDA will be subject to FDA fines and prosecution. To give manufacturers time to adapt to these new regulations, the FDA announced that it would start enforcing these new regulations in August 2022.

As the deadline May 12 2020 (PMTA) draws closer. I think that we as a Vaping community should continuously do are part to inform those who don’t know just what devastation this will cause our vaping industry in the United States.

I’m sure ALOT of people in this vaping community and many others are sick of hearing, reading, and discussing this topic. The dreaded May 12 pmta deadlines. And I know I have read and had many conversations on threads about this deadline. Nobody ever agrees totally on this subject or the outcome. Because no one knows for sure how it all ends. And that I can appreciate. But what I can’t accepts are the amount of vapers that have no idea of the possible impending doom coming to the vaping industry. Study: Prevalence of vaping and smoking among adolescents in Canada, England, and the United States (BMJ, 2019)

Here's an interesting study I found in the British Medical Journal (published June 2019) examining "differences in vaping and smoking prevalence among adolescents in Canada, England, and the United States". No login needed.

Some of the main findings, comparing 2017 data to 2018 (remember everything here refers to adolescents only):

  • Prevalence of smoking increased in Canada and stayed the same in the US and England
  • Prevalence of vaping increased in Canada and the US across most measures, while it stayed roughly the same in England
  • Prevalence of vaping among never smokers or experimental smokers (< 100 lifetime) increased in the Canada and US across most measures, and no changes were observed in England
  • Almost a third (28.1%) of 30 day vapers in the US reported Juul as their primary brand, an increase of almost 20% (from 9.4%). In England and Canada respectively, it went from 0% (it wasn't on the market yet) to 10.3% and 3.3%.

TL;DR: In most cases in US and Canada, more adolescents are taking up vaping, are vaping with increasing frequency, but not quitting smoking in higher rates, and the Juul is phenomenally popular. England is the notable exception, where largely nothing has changed.

Discussion

  • Previous years of this data set showed adolescents regularly (15 days or more) vaping at much lower rates than smoking, "characterized by infrequent, experimental use." The gap has now closed, without any significant reduction in adolescent smoking rates.
  • The increase in Juul use is consistent with Juul sales over the same period, suggesting adolescents are "almost entirely responsible" for Juul's overall growth in the US market. They also captured 10% of adolescents as regular users within a month of going on sale in Canada, despite only being the third most popular brand there (that is 10% of all adolescents, not just vapers).
  • There are a number of possible reasons offered about why England has avoided the rapidly increasing prevalence of adolescent vaping: Juuls in the UK are limited to 20mg/l (less than half the content of the US and Canada Juul), limited retail availability, marketing restrictions on vaping products, and differences in public health messaging
  • Probably the most controversial part of this study is that they directly link the availability of nic salt-focused devices like the Juul and other pod systems to the increased prevalence rates and frequency among adolescents, due to their sle
