About 7 years ago a dam was replaced in the development I live. The owner of the lake signed the loan and the township co signed it. They had to start making payments now and payed the first one but do not have the money for the next payment, which is due is about 30 days. As a result they are saying they can become an HOA and mandate everyone to pay not only for the dam loan but also additional dues.
From previous cases I saw courts mandating property owners to share the cost of the dam but not additional dues. They also gave this information to the community with 30 days before defaulting on a loan when they knew this was going to happen for years.
It is a private lake but people out of the development can but a membership which I think is a key difference between other cases.
