Abolition of Unnecassary Laws Act

There are many rediculous laws in New Hampshire that I LtUnknown06 want to rid of, so here it is.

Section A: Sunday Laws

  1. Machinery is allowed to be operated when ever wanted.

  2. Any other Sunday laws shall be abolished or prohibited unless another govenor should repeal this. Religious practices will stay personel.

Section B: Nature Clean Up

  1. Seaweed can be picked up whenever someone feels like it on a beach at night now. Yes this law existed.

  2. You can now pick up trash at White Mountain National Park. This was also a very idiodic law.

Section C: Any other regulations

  1. You may now employ ferrets while hunting.

  2. Cattle no longer have to be fitted with devices so their feces can be tracked.

  3. While in a public bar or tavern, it is no longer against the law to keep time with the music by nodding, tapping your foot, snapping, etc.

  4. The pour holes in restaurant sugar dispensers can be as wide as you want.

This is to be put into effect immediatley.

  1. The death penalty is a form of punishment by killing a prisoner as punishment for their crimes
  2. The problems that the death penalty faces are that an innocent person would be executed in place of the culprit yet without the death penalty an innocent person would be released once the actual perpetrator have been apprehended and that it violates the right to life.
  3. With the passage of this bill the death penalty for all crimes will be abolished effective immediately
  4. All prisoners on death row will not be executed instead their sentence will be reduced to life imprisonment

###II. ARGUMENT

A. /u/CooIey0’s vote on B.328 was invalid.

On October 18, 2020, /u/CooIey0 is recorded as having voted in favor of B.328. Fifteen days earlier, on October 3, 2020, /u/CooIey0 had sworn in as a member of the United States House of Representatives. Upon taking their oath of office, /u/CooIey0 became entitled to the compensation due to all members of Congress. 2 U.S. Code Β§ 5302.

The state constitution specifies that β€œNo member of the General Assembly shall receive compensation as a public officer or employee from any other governmental entity for time during which he is in attendance as a member of the General Assembly.” Linc. Const., art. 4, Β§ 2(b). Furthermore, β€œNo person may hold a federal position and a major state position or state legislator position concurrently.” Meta Const., art. II, Β§ 9(a).

Thus, upon taking their oath of office as a member of the United States House of Representatives, /u/CooIey0 ceased to be a member of the General Assembly of the State of Lincoln and subsequently forfeited their power as a member of the General Assembly, in which β€œlegislative power is solely vested.” Linc. Const., art. 4, Β§ 1. Therefore, he no longer possessed the authority to vote on legislation under consideration by the General Assembly and his vote on B.328 was invalid.
