Although it's slowly dipping now due to Brexit, I need to sell the property. Most people aren't willing to buy when there's existing tenants in there as they're contractually bound to follow landlord obligations.
Problem is, the tenant that lived there in 1998 now has kids and she's dependent on them as their carer I believe. She's been able to pay the rent for the past two decades because she's a DSS claimant, and her kids work to pay the rent.
By the way, the rental yield I'm getting for this is really poor, adjusting for inflation, I believe I'm making less than my mortgage on it, even if I renew my mortgage and find the lowest interest. If I could, I would easily charge rent of approx Β£1,800 pcm as that's the typical price of a 3 bed property in Kensington. However, it's been the same rent since 1998, which is Β£395 pcm.
Asked for a free consultation with a solicitor and they said the law back then means a section 21 notice can't be provided as it is not an AST or anything that is contractually bound and they cannot be evicted with such notice. In other words, it is not an assured tenancy.
Please help. Is there anyway to evict these tenants?
