RESPONSE: Assuming that Paragraph 6 of the Complaint refers to GameStop’s annual meeting of stockholders held on June 9, 2021, admitted. If that assumption is incorrect, denied.
- In every vote but one, the total number of votes added up to 55,541,279.
RESPONSE: Assuming that Paragraph 7 of the Complaint refers to GameStop’s annual meeting of stockholders held on June 9, 2021, admitted only that after the Inspector of Elections selected a reasonable method to obtain whole numbers by rounding vote totals that reflected partial shares, the total number of votes and broker non-votes cast in the elections for five of the six director nominees and for both of the two management proposals was reported to GameStop by the Inspector of Elections, and therefore reported in GameStop’s Form 8-K dated June 9, 2021, as having been cast by 55,541,279 shares of GameStop’s Class A Common stock. I have a couple bummers.
The first bummer is that I have withdrawn my case from the Court of Chancery. I did that because I overlooked a technicality; namely, that I didn't affirm my initial demand for inspection to be true under penalty of perjury under the laws of the United States. As a result my case won't go forward.
The following is what specifies it—
(3) “Under oath” includes statements the declarant affirms to be true under penalty of perjury under the laws of the United States or any state.

See, I forgot to affirm the facts in my demand to be true and sign my name at the bottom (they really like that part).
They also claim I lack credible basis to inspect the stockholder ledger. Now, I am really not sure, after reading Section 220 over and over and over, that inspecting the stockholder ledger requires a litigant to provide a credible basis for wrongdoing, etc. Instead, the language directs that the stockholder provide a PROPER PURPOSE for inspecting the ledger, and places the burden of proof on the company to demonstrate that the stockholder's purpose for inspection is improper. That can be for future legal warriors to hash out further.
The second bummer is that I am stepping back from pursuing this course of action. Certain conditions that obtained which gave me the liberty to engage in this time-consuming work (figuring shit out, writing shit, mailing shit, getting shit notarized, getting shit served, etc.) are no longer obtaining, and I will be having to donate larger amounts of my time to non-GME-related activities. In addition, having dismissed my suit hampers me from pursuing it in the future.
I realize that this is disappointing to many, including myself. My desire is to be NOT the ape who gets the farthest with this. To that end, I have been as transparent about this process as I can be, and I will provide all advice and assistance I can to anybody who carries on this effort.
If I were to transport my consciousness into another person's body and proceed, my next step would be to submit a signed, notarized Demand for Inspection that addresses the deficiencies identified by the good GameStop lawyers. The below text of the Defendant's Response to Plaintiff's Motion to Expedite would help with that.

We are Todd Moore and Dana Moore.
Our cherished eight-year-old son, Michael, was brutally murdered on May 5, 1993 by Jessie Misskelley, Damien Echols, and Jason Baldwin. Misskelley was tried and convicted in 1994. Baldwin and Echols were convicted by a separate jury later that year. All three entered Alford pleas to our son’s murder August 19, 2011. They are now, as they have been for the past 17 years, guilty as a matter of law. They have been guilty as a matter of fact since the moment water flooded Michael’s lungs after he was beaten, stripped, hogtied, and then discarded into a stream to drown.
Michael was the joy of our lives. In addition to our son, his murderers also tortured and slaughtered two other children, Christopher Byers and Stevie Branch. These three precious victims were classmates and friends, and their loss was a tragedy felt throughout the entire community.
We are horrified to learn that a documentary that glorifies Michael’s killers, Paradise Lost III: Purgatory, is among 15 documentaries being considered for an Academy Award. Because of public pressure that exploded due to gross misrepresentations of fact in two previous documentaries, Michael’s killers were unjustly able to enter into a plea agreement, were released from prison, and now pose additional threats to society. This third documentary further insulted the families of these three boys and may lead to further injustice. We implore the Academy not to reward our child’s killers and the directors who have profited from one of the greatest frauds ever perpetrated under the guise of a “documentary film.”
We realize that documentaries have a point of view and advocate a position to some degree or another. As with the two before it, this film crossed the line into a cruel hoax that had real-life consequences larger than even those of us who still mourn our horrific losses. It is not art. This film is cynical and exploitative deception that compounds our pain needlessly and rewards those who inflicted it. It and the two films that preceded it are simply tasteless tabloid entertainment presented as social commentary.
We are private individuals. The directors, Bruce Sinofsky and Joe Berlinger, are aware of this because we refused to participate in their last two films. We appeared solely in the first film because the directors lied and told us their purpose would be to “protect children.”

On the sixth day of their deliberations, jurors mulling the fate of Jeffrey Epstein’s accused accomplice Ghislaine Maxwell requested testimony by defense witnesses for the first time. The jury also asked about the scope of presiding U.S. District Judge Alison Nathan’s instruction that they will work every day until they reach a verdict.
The panel of 12 diverse men and women wondered whether that meant they could be spending New Year’s Eve and New Year’s Day inside the Thurgood Marshall U.S. Courthouse in lower Manhattan.
Judge Nathan made clear that they might.
“Yes, you will continue deliberations as needed, every day, going forward,” Nathan said, adding this would include the New Year’s holidays and the Sunday immediately following it.
The jurors can inform the court whether this instruction poses a “substantial hardship” for them because of unmovable conflicts. Late afternoon on Tuesday, the judge indicated that she would urge daily deliberations until verdict time because of an “astronomical spike” in COVID-19 cases, as the omicron variant ravages through New York City, where the trial is taking place.
“We are, very simply, at a vastly different place regarding the pandemic than we were only a week ago,” Nathan said on Tuesday. “We now face a high and daily escalating risk that jurors and/or necessary trial participants would need to quarantine, thus disrupting trial and putting at risk our ability to complete this trial. Put simply, I conclude that proceeding this way is the best chance to both give the jury as much time as they need and to avoid a mistrial as a result of the omicron variant.”
Before the COVID scare, Judge Nathan initial told jurors court would be adjourned on Thursday, Friday and the weekend.
Pressed by defense attorneys to clarify she is not rushing them toward a verdict, Nathan has told jurors: “You should take all the time that you need.”
Jurors appear to be taking that remark to heart.

Ghislaine Maxwell held a meet and greet with an ABC News journalist in court during the sixth day of jury deliberations in her sex trafficking trial.
James Hill, senior producer and investigative journalist for ABC News, was invited by one of Maxwell's lawyers to sit on the front bench of the public gallery and talk to her Wednesday morning.
Hill, who won an a Murrow Award for producing the podcast Truth and Lies: Jeffrey Epstein, appeared to introduce himself to Maxwell who smiled back and did the same.
They chatted for a few minutes before Hill returned to his seat on the press bench, moments before the judge came back in.
The bizarre interaction suggests that Maxwell is lining up TV interviews as the jury remain seemingly deadlocked.
On Wednesday the jury requested five more transcripts in an early morning note.
They asked for the evidence from Shawn, the boyfriend of the accuser Carolyn; Cimberly Espinoza, Maxwell's personal assistant at Epstein's New York office, and the defense 'false memory' expert Elizabeth Loftus.
They also asked for testimony from FBI agents Amanda Young and Jason Richards, the lead agents in the 2019 investigation into Jeffrey Epstein.
In a note in the afternoon on Wednesday the jury asked for the transcript of the testimony from Larry Visoski, Epstein’s other pilot.
The jury has now asked for the transcripts of 14 witnesses: there were 33 in total for the defense and prosecution.
On Tuesday the jury said in a note they were 'making progress' but they now seemed to be back in the thick of their deliberations.
The jury also asked for 'clarification' as to whether they would be sitting over New Year's Eve and New Year's Day so they could 'plan our schedules accordingly', suggesting they were expecting to sit that long.
Judge Nathan said she would send a note confirming they would be sitting every day including the weekend until they reach a verdict because she was 'greatly concerned' about a mistrial due to a juror or trial participant like Maxwell getting sick with Covid-19.
Maxwell, wearing a purple turtleneck and black pants, looked in a good mood and at one point smiled and pointed a finger at her lawyer Laura Menninger in a jokey fashion.
