SK Miami Partner, Jennifer V. Ruiz, was appointed by the U.S. Court of Appeals for the Eleventh Circuit as Amicus Curiae on behalf of unrepresented gas station defendant-appellees in an ADA case.
ADA plaintiff and his counsel appealed an order entered by U.S. District Court Judge for the Southern District of Florida Paul C. Huck imposing unprecedented sanctions upon an ADA plaintiff and his counsel upon finding they had abused the judicial system by operating an illicit joint enterprise, consisting of knowingly filing frivolous claims, submitting inflated attorneys’ fees, making misrepresentations to the court, and engaging in unethical fee-sharing.
The District Court imposed sanctions against the ADA plaintiff and his lawyer including monetary penalties, community service, and an injunction prohibiting both from filing any future ADA claims in any federal or state court without prior judicial screening and approval.
Jennifer V. Ruiz with the assistance of Miami Partner, Alexandra Valdes, submitted an Amicus Answer Brief on behalf of the gas station defendant-appellees, which was presented at oral argument before the Circuit Court.
The Court affirmed the sanctions imposed against the ADA plaintiff in full and dismissed the appeal of his lawyer for lack of subject matter jurisdiction.
