I have heard it been stated over and over again on the internet that "Weird" Al Yankovic has the right to perform and publish his song parodies even if the original artist/rights-holder fails to give him permission, but he always makes sure to do so out of courtesy.
But the Supreme Court holding seems as clear as mud to me (as a non-lawyer), and Googling doesn't clarify the matter. Can anyone shed some light on the matter for me?

In 1991, Warner Music was sued for having used an uncleared sample in "Alone Again", a song from Biz Markie's third album. Warner Music lost, and the judge even referred the case for criminal prosecution (considering it theft).
According to Wikipedia, "as a result of the court case, the sound of hip hop music, heavily based upon combinations of various samples from various sources, was forced to change. Records such as those produced by The Bomb Squad for Public Enemy, filled with literally dozens of samples, were no longer possible: each and every sample had to be cleared to avoid legal action" (link)
How was sampling viewed from a legal standpoint before this trial? Was the change in the legal environment responsible for the change in copyright owner's attitude? Was the lack of cultural acceptance of hip-hop by the mainstream (at the time) a factor in the trial outcome?
The interaction of Anime and US copyright law has had a long history since the early days of bootlegged VCR tapes of Akira to the now streaming formats we all use. It is a vast topic that spans almost all the fandomβs activities from piracy to cosplay and fanart, and even the r/Anime Awards we hold every year on this server.
Naturally, because of the breadth of this topic, Iβll try to focus the discussion on what has been likely the most recognizable and common form of piracy in the Anime community: Fansubbed/translated Bootlegged Copies of Anime.
##B: The Beginning
The interaction between Anime and US copyright law begins in the same place all Anime does: Japan. When an artistic work like an Anime episode is made in Japan, it is copyrighted (this is known as fixation). The Anime is then given the same copyrighted status in the United States, under a principle known as reciprocity. ^[1]
This reciprocity is largely because both the US and Japan are signatories to something called the Berne Convention. Simply, the Berne Convention is an international treaty that makes a copyrighted work in one signatory country, a copyrighted work in all the other countries that signed the treaty.
In short, Anime that is copyrighted in Japan is copyrighted in the US. (So, unfortunately, while Anime can be reincarnated in another country it sadly changes nothing).
##Inside the Domain of US Copyright Protection: Monopoly Rights
Ok, I get it /u/jonlxh, Anime is Copyrighted in the United States. But what does that even mean? It means that the Copyright owner of the Anime is afforded some privileges or rights, which can be bought, sold, and licensed. These rights are mostly based on the idea of granting the copyright owner some measure of a monopoly. But why give them a monopoly you ask?
Well...it gets kinda esoteric and political. In essence, the idea is that we want to live in a society where people make interesting and useful things. So if we give people a monopoly for making something society loves. They can get rich or at least profit from it. Because everyone wants to get rich, more people will want to make something society or other people love.^[2][3] Thus, making a society where people make interesting and useful things. At first, my proposed topic was work-related. However, after a discussion with my professor, we realized that the opportunities for argument in my topic were limited (i.e., there was little controversy). Instead, I changed my topic to the Legality of Fanfiction.
To be honest, in addition to be a fun project (writing about something I love), it was also an eye-opener for me. I discovered AO3 falls under the umbrella of the Organization for Transformative Works (OTW). In addition to being non-profit, OTW's work includes legal advocacy work and they publish a bi-annual journal called Transformative Works and Cultures. The journal is filled with scholastic articles on the subject of fanfiction (editorials, praxis, symposium, book reviews, etc.). It's by no means light reading, but there is always at least one or two article titles that peak my interest.
Has anyone else used Fanfiction as a topic for a college paper or done their own research? What were some eye-opening or interesting articles that you found?

I own a posters shop. Many peopel ask me about posters from games or with covers of games. So my question is - is it allowed to make a screenshot from game and sell it as poster? How is it with covers - they are for marketing purposes of the game, but would sales be allowed? Im asking because its often hard to find somebody ie in EA or DICE to answer me those questions.

The only announcement for today is in the matter of /u/Rolfeson v. /u/Trips_93. This copyright infringement case was brought under our rules for cases and controversies, and was heard by a three-Justice Panel.
Plaintiff Rolfeson alleges that Justice Trips_93 committed copyright infringement in a comic posted to ModelUSpress. Defendant responded by pleaded the defense of fair use under 17 U.S.C. Β§ 107.
Abstract
BSDDC, J., delivered the opinion of the Panel, to which RestrepoMU, J., joined. Notevenalongname, J., dissented.
The Panel found that Defendant's secondary work did infringe on Plaintiff's copyright. Plaintiff proved both the ownership of a valid copyright in his comic and that Defendant's work copied original constituent elements from Plaintiff's comic.
Drawing from Campbell v. Acuff-Rose Music, Inc the Panel found that Defendant's work parodied the original, and was therefore transformative. As such, the Panel delivered a judgment for the Defendant.
Dissenting, Justice Notevenalongname would hold for the Plaintiff because the Panel erred in its application of the Β§ 107 factors. Justice Notevenalongname disagreed with the Panel's finding of transformative use. Further, the Justice criticized the application of a superseding inquiry from Folsom v. Marsh, because "[i]t is universally recognized that a use that 'supersede[s] the original' is not protected by the Fair Use Exception." Justice Notevenalongname would have found for the Plaintiff.
The Panel has concluded our work on this case, and the Court's business continues.

With Alex and his cohorts vaguely threatening legal action or some other repercussions against DrApeis and the rest of the Love Letter devs, I thought I'd dissect what his actual legal claims are and the seeming likelihood of succeeding on those claims.
Full disclosure: I am not a lawyer, and certainly not a copyright attorney. I am, however, a law school student and several months ago had to research and present a case on copyright law, so I'm at least fairly familiar with the general laws and their application.
Upfront, I'd like to be clear, Alex likely has no real case against Love Letter. Even if he did, it's virtually certain that the costs of litigating would dwarf whatever he'd get out of it. The most I could reasonably expect him to do is send a toothless cease and desist letter and gamble that he can bluff Apeis and the other LL devs to back down.
The controlling case law for copyright infringement claims in the US stems from the Supreme Court Campbell v. Acuff Rose which articulates the four factors needed to find copyright infringement and their application. The factors are: 1. What the purpose and character of the derivative work is; 2. The nature of the copyrighted work; 3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole; and 4. The derivative workβs effect upon the market for the original. These factors are all conjunctive, they must ALL be met in order to have a valid claim of copyright infringement.
To break this down a bit: "Purpose and character of the derivative work" largely means how much the new work is transformative, how much it's differentiated from the original. Now, the original Love Sick trailer is incredibly similar to Yandere Simulator, the main character looks very similar, the school seems very similar, the overall art style is very very similar to Yandere Simulator. Later uploads related to Love Sick, when it turned over and became Love Letter, however, do not share much in common with Yandere Simulator beyond a concept and general art style, neither of which are actually copyrightable.
The second point, the "nature of the copyrighted work" deals with what, exactly, is being infringed on. Some works are more liable to copyright than others- a fictional story is more susceptible to infringement than a factual one, for example. This factor is not really very important. In my opinion, no legal doctrine is more misunderstood than fair use. Here are just a few commonly believed myths about fair use:
I can expound on the first three if anyone is interested (in a nutshell: there is no such thing as slam dunk fair use. Fair use as a concept is incredibly nuanced and complex and requires case by case analysis of four factors which are weighed with and against each other) but this post is about the fourth "myth".
The notion that fair use is a privilege or a right is fundamentally and unequivocally untrue under American copyright law. It's certainly not a right, nor is it even a privilege. It's only a defense to a claim of copyright infringement.
Moreover, it's not just only a defense, it's actually an affirmative defense (see U.S. Supreme Court case Campbell v. Acuff-Rose Music, Inc. 510 U.S. 569 (1994)) For those unfamiliar, unlike regular defenses which must be disproved as false by plaintiffs in civil court actions, affirmative defenses must be raised and proven as true by the defendants.
Why is this important? Well, I would caution anyone who is thinking of making unauthorized use of another's copyrighted work assuming that he/she can rely on a believed right to a believed obvious fair use. You can't.
Let's say, for example, you want to post to YouTube a 30-second clip from a half-hour long episode of your favorite TV show, "Reddit: The TV Show", copyright in which is owned by Reddit Inc.
That act is copyright infringement. (Specifically, it infringes Reddit Inc.'s reproduction and distribution rights under Section 106 of the Copyright Act.):

TLDR:
This post comes to you after after discovering the SMELL test which lead to WWE opening her legs at +10%, climaxing at +25%, and cuddling to +11% at close. All this on a day with zero news, except my one moderately successful WSB post.
WWE's IV of 35% implied a 2.2% stddev in daily price change... so an 11% close represents a 5 sigma event. My take is that WWE got pregnant after getting fucked by WSB wearing five condoms. I think MMs got defensive by pumping up the ask and IVs during PM, possibly due to seeing sentiment pop. (Unfortunately, it didn't take WWE long to start showing pregnancy sickness -- she regurgitated some gains in the last couple of days.)
WWE definitely came, and so did I. My FDs were up 2500%, and Jan LEAPs up 250%. However, in an act of sheer horniness after spending all day furiously writing the DD, I had posted it after close. So only those able to get in at open were able to appreciate the climax. I'm not making that mistake this time.

The law that covers this usage is the "Fair Use" clause of the Copyright Act of 1976, 17 U.S.C. Β§ 107 ("Limitations on exclusive rights: Fair use"), which protects "public domain" data.
Under Β§ 107, the fair use of a copyrighted work is not a copyright infringement, even if such use technically violates Β§ 106 ("Exclusive rights in copyrighted works") and Β§ 106A ("Rights of certain authors to attribution and integrity"). While fair use explicitly applies to use of copyrighted work for criticism, news reporting, teaching, scholarship, or research purposes, the defense is not limited to these areas.
One caveat, explored in a prior legal battle, "Perfect 10 vs Google and Amazon" case (2006), was whether or not the Copyright Act protects screenshots of copyrighted images. The verdict was that the screenshots are allowed because the copyrighted images were posted publicly on the Internet, e.g. public domain. Court ruled that Google transformed the images from a use of entertainment and artistic expression to one of retrieving information, citing the similar case, "Kelly v. Arriba Soft" (2003).
There were also similar verdicts about "fair use" of some types of music videos and Youtube. In "Lenz vs UMC" case (2008) the court ruled that copyright holders cannot send order a deletion of an online content (UMC's takedown notices on Youtube) without determining whether that content reflected "fair use". And a number of appellate decisions also have recognized that a parody is a fair use regardless of the copyright holder's permission (including its commercial use and parody of copyrighted songs).

TLDR:
This post comes to you after after discovering the SMELL test which lead to WWE opening her legs at +10%, climaxing at +25%, and cuddling to +11% at close. All this on a day with zero news, except my one moderately successful WSB post.
WWE's IV of 35% implied a 2.2% stddev in daily price change... so an 11% close represents a 5 sigma event. My take is that WWE got pregnant after getting fucked by WSB wearing five condoms. I think MMs got defensive by pumping up the ask and IVs during PM, possibly due to seeing sentiment pop. (Unfortunately, it didn't take WWE long to start showing pregnancy sickness -- she regurgitated some gains in the last couple of days.)
WWE definitely came, and so did I. My FDs were up 2500%, and Jan LEAPs up 250%. However, in an act of sheer horniness after spending all day furiously writing the DD, I had posted it after close.
