Bill Clinton and David Kessler (FDA Commissioner during Clinton’s first term) argued that the laws that created the FDA gave it the power to regulate tobacco because nicotine is a “drug”. Brown & Williamson sued the FDA, claiming that the FDA didn’t have this power. It went to the Supreme Court, where they ruled 5-4 that the FDA can’t regulate recreational drugs. With the Republicans in control of Congress, this left the FDA unable to regulate tobacco until Obama became President.
