I story time, My family and I have lived in a duplex for 6 years now. New owner 07/2020.Up until now the have been 2 meters on the units but the wiring has a foreign load so they simply included utilities in the rent. Landlord has had us try to sign predatory leases before this
Two months ago 8/2021 the new management company sent out a letter that the owners wanted us to put the utilities in our name and sign a new lease as ours had expired.
August 23- I explained in writing on the communication portal that there was a foreign load and we would end up paying for the other units electricity
sept-22 Month later we asked for update on bringing the wiring up to code
Sept 28- They asked us tp sign new lease as ours had ended, and demanded utilities in our name. When asked about wiring, they responded that they would fix it AFTER we signed a new lease and put utilities in our name. We declined.
Oct 31-They left a Notice to Quit *30 days* for:"Lack of not turning utilities (electric and gas) in your name and not signing the lease dated oct 1, 2021 with terms regarding utilities" <~~~exact wordsAt no time did I withhold rent, even after the notice. How should I proceed?
TL:DR Landlord tried to make me pay for utilities multiple units and then gave me too short of an eviction letter.
Edit perhaps just Section 38-12-505 and retaliation therein under § 38-12-509, Section 38-12-505(1) (XII) Compliance with all applicable building, housing, and health codes, the violation of which would constitute a condition that materially interferes with the life, health, or safety of the tenant
